Some of them are registrable, and some of them are not. So let’s go from the least registrable towards most registrable. Least registrable trademarks are generic trademarks. So basically, a trademark that is simply the common name for the product or the service is called generic. So If I am selling pens, the word “Pen” would be generic if somebody wanted to trademark that. Or phones, so if I want to trademark the word “Phone” if I am selling phones, I’d be denied because it is generic. If I am selling cars I can’t trademark the word “Car.” If I am selling the trademarking services, I can’t register the phrase “Trademarking services”, or just “Trademarking,” or “Trademark.” Slightly above that are descriptive trademarks. Descriptive trademarks are more than just naming the product but they do nothing more than tell the market about certain characteristics, or features, or benefits of your product or service. So if you’re selling printers, you can’t trademark the word “Color,” because that’s the feature of your printers. Or if you’re selling accounting services, “Timely Accounting Services” would be a descriptive trademark. It is not generic—it would be generic, if it had been simply “Accounting,”—because you’re adding something to it, but what you’re adding is only a description of the characteristic of your product or service. So “Timely Accounting Services” or “Pure Gold Bracelets”... Again, the name of the product is “Bracelets”—it’s generic; “Gold”—that’s descriptive; “Pure Gold”—still descriptive. Above that there are suggestive marks. Suggestive marks are those that give the customer some idea about your product or service, but they don’t just describe a main feature, or main characteristic, or one of the main features or characteristics, in a way that adds nothing to the trademark in terms of identity. So the good example here would be “Trademark Factory®”. When you hear the phrase “Trademark Factory”, you know that what we offer is trademarking services, but really, the word “Factory” does not tell you exactly how we are different from others, how are we better than others, it doesn’t tell you anything except that in some shape or form, we offer trademarking services. That’s a suggestive mark. Above that, there are arbitrary marks. They use dictionary words that have nothing to do with the product or the service. And the best example here is “Apple.” Apple is not in the business of selling apples, otherwise it would have been a generic mark. But they use the word “Apple” to sell computers and phones and software. And none of this has anything to do with apples. So they use a dictionary word in connection with unrelated products and services, thus making it an arbitrary mark. And finally there are fanciful trademarks. When you come up with a word that did not exist,that means nothing, it’s not in the dictionary and you just came up with that name and thought it would be a great name for a product or a service, and you give it that name—and it’s also very trademarkable. A good example for that would be—and there are so many of them—and something tells me, if I come up with a name as an example, I would get some comments that actually this means something in some other language, but I’m still going to give it a try. And if I’m wrong with an example, you’re welcome to post your comments and correct me, but you’ll still get the point. So for example, “Sony” or “Yamaha”. This means nothing, at least in English. Some of the most famous fanciful trademarks are Xerox, Kodak, and Exxon. Some other good words that used to be fanciful marks are “Escalator”, “Aspirin,” and “Linoleum.” They used to be fanciful marks that mean nothing, that did not exist, but now they are generic marks or very close to generic marks in case of Aspirin. Somebody came up with a name, they gave this name to a product. But they became so prevalent on the marketplace that people started using those names as generic names. The Trademark Office and the courts concluded that, if Otis used their trademark in that generic way, they could not stop Westinghouse from calling its moving staircases "escalators", and a valuable trademark was lost through genericization. The pharmaceutical industry affords some protection from genericization of trade names due to the modern practice of assigning a nonproprietary name for a drug based upon chemical structure. Brand-name drugs have well-known nonproprietary names from the beginning of their commercial existence, even while still under patent, preventing the aforementioned problem of "no alternative generic name for the idea readily comes to mind". For example, even when Lipitor was new, its nonproprietary name, atorvastatin, was well known. Examples of genericization before the modern system of generic drugs include aspirin, introduced to the market in 1897, and heroin, introduced in 1898; both were originally trademarks of Bayer AG. U.S. court rulings in 1918 and 1921 found the term to be genericized, stating the company's failure to reinforce the brand's connection with their product as the reason. Bayer's involvement in the Great Phenol Plot during World War I, and subsequently the U.S. declaration of war on Germany, were also involved in the case of aspirin and heroin. Could you buy the url “applecart.com” and then register “applecart.com” as a trademark in an effort to prevent a competitor from using a confusingly-similar term on their own apple cart? In short, no. In general, trademark law doesn’t allow anyone to claim as a trademark any term that is “generic.” What is a “generic” term? It’s anything that is the name for the product or service that is the subject of the claimed trademark. For example, I can’t register the term “car” for automobiles, because it’s generic; the mark sought to be registered is the name for the goods in the trademark. The reason why generic terms can’t serve as trademarks is twofold: 1) Generic marks are not distinctive. The purpose of a trademark is to distinguish your goods and services from those of another company. When the proposed trademark is the name of the “thing” it’s not at all distinctive of the source of the goods, it’s just the common name for the goods. That does not distinguish the goods as coming from your company versus coming from another company, thus the term fails to function as a trademark. 2) The grant of a trademark registration to one company necessarily prevents others from using that term with those goods, so it would prevent others from fairly describing their goods and services. A trademark grants to the owner the exclusive right to use that mark in commerce with those goods or “related goods.” If we were to grant one company the trademark CAR for automobiles, it would necessarily prevent other automobile makers from saying that they, too, manufacture cars. Marks can, through improper use, become generic when (paradoxically) the trademark becomes so famous that consumers start calling the goods that are the subject of the trademark by the trademark itself. This is how Otis Escalator Company lost the trademark for ESCALATOR, and ASPIRIN, ZIPPER, and CELLOPHANE suffered a similar fate. Because of this, many famous brands are vigilant about calling their products things like “Kleenex brand facial tissue,” or “Band-Aid brand bandages.” It’s important to realize that the question of whether a mark is “generic” is always analyzed in the context of the goods and services. While the mark APPLE is generic for a fruit cart that sells apples, the mark APPLE is distinctive for use on electronics. This is because in the first instance, the mark is the word for the goods, and in the second instance, the mark is distinctive for the goods, and lacking any qualities that would tend to describe the goods. Welcome to the Investors Trading Academy talking glossary of financial terms and events. Our word of the day is “Brand Equity”. Brand equity is a phrase used in the marketing industry which describes the value of having a well-known brand name, based on the idea that the owner of a well-known brand name can generate more money from products with that brand name than from products with a less well-known name. One situation when brand equity is important is when a company wants to expand its product line. If the brand's equity is positive, the company can increase the likelihood that customers will buy its new product by associating the new product with an existing, successful brand. For example, if Campbell's releases a new soup, it would likely keep it under the same brand name, rather than inventing a new brand. The positive associations customers already have with Campbell's would make the new product more enticing than if the soup had an unfamiliar brand name. Companies can create brand equity for their products by making them memorable, easily recognizable and superior in quality and reliability. Mass marketing campaigns can also help to create brand equity. If consumers are willing to pay more for a generic product than for a branded one, however, the brand is said to have negative brand equity. They allowed C++ programmers to express a lot of control over how memory is used in concurrent programs and made portable lock-free concurrency possible. They also allowed programmers to ask a lot of questions about how memory is used in concurrent programs and made a lot of subtle bugs possible. This talk analyzes C++ atomic features from two distinct points of view: what do they allow the programmer to express? what do they really do? The programmer always has two audiences: the people who will read the code, and the compilers and machines which will execute it. This distinction is, unfortunately, often missed. For lock-free programming, the difference between the two viewpoints is of particular importance: every time an explicit atomic operation is present, the programmer is saying to the reader of the program "pay attention, something very unusual is going on here." Do we have the tools in the language to precisely describe what is going on and in what way it is unusual? At the same time, the programmer is saying to the compiler and the hardware "this needs to be done exactly as I say, and with maximum efficiency since I went to all this trouble." This talk starts from the basics, inasmuch as this term can be applied to lock-free programming. We then explore how the C++ lock-free constructs are used to express programmer's intent clearly (and when they get in the way of clarity). Of course, there will be code to look at and to be confused by. At the same time, we never lose track of the fact that the atomics are one of the last resorts of efficiency, and the question of what happens in hardware and how fast does it happen is of paramount importance. Of course, the first rule of performance — "never guess about performance!" — applies, and any claim about speed must be supported by benchmarks. If you never used C++ atomics but want to learn, this is the talk for you. If you think you know C++ atomics but are unclear on few details, come to fill these few gaps in your knowledge. He says: "What we're talking about doing with the new generic top-level domain program is blowing the lid off that ceiling of twenty two. The interest is there to expand that. We no longer have to keep this to twenty-two. It can be almost any word combination. It can be in non-Latin characters, which is extremely important if you happen to speak Russian because of the Cyrillic alphabet, or Arabic, or Chinese." ICANN officials met in October in Dakar, Senegal. Brad White says they discussed the new program for what are known as gTLDs. "This marks one of the biggest changes in the Internet's domain name system, the addressing system of the Internet, that has ever occurred. We want to make sure that the process of getting these gTLDs into the Internet's root is methodical, careful and thoughtful." Anyone can apply, including businesses, governments and individuals. The cost of a new name: one hundred eighty-five thousand dollars. Mr. White says: "That's the cost that we've determined that is necessary to make sure that the applicant has the technical savvy to run an Internet registry, that there is no intellectual property or trademark problems, so on and so forth. But that hundred and eighty-five thousand is miniscule compared to the cost of actually operating an Internet registry." In Dakar, ICANN passed a resolution to consider creating a support system to help rising economies with limited financial resources. For example, ICANN says Africa represented less than twelve percent of Internet growth worldwide in the last ten years. But Mr. White says that is slowly beginning to change. ICANN will accept applications from January twelfth to April twelfth. It could take up to a year for new names to become active. For legal advice, please contact a lawyer. Question 1: Will you get sued if you use product images from Aliexpress suppliers? The answer to this is almost certainly no. In China, the culture around copyright is very different to the western world. In China, the culture around copyright is that if something can be easily copied and can benefit others, then that is more important than protecting the rights of a single individual. It is a cultural difference. As a result, it’s very easy to get away with piracy in China, which is why pirated movies/music/games are sold freely on the streets. In fact, Chinese manufacturers copy each other all the time. Not only do they produce the same products, they steal images from each other. If you go to Aliexpress you will see that different manufacturers are producing the same items, and they are using the same images. As a result, it is extremely unlikely that any Aliexpress supplier would try to pursue you in court for any copyright issues. If they were going to sue anyone - it would be the manufacturers that are copying them - although due to the cultural differences, that is also extremely unlikely. If you’re still worried, you can contact the Aliexpress suppliers and ask them if they are OK with you reusing their images. Question 2: How Can I Avoid Being Sued for Copyright Images? They might not care in China if you copy images - but in the west, they sure do! Even if your website is not making any money, you can still be pursued legally and sued for using images without permission - so it’s very important that you don’t use copyrighted images on your website! A good place to find images you can use is with Google Images: 1) Go to Google Images 2) Click settings. 3) Click advanced search. 4) Type in what you’re searching for. 5) Scroll down to usage rights. Select “free to use, share or modify, even commercially.” 6) Click search. You’ll be surprised at how many images you’re allowed to use! So don’t get lazy and use images that are copyrighted. Use Google to find free images you’re allowed to use. Question 3: Can I Sell Aliexpress Products that are Trademarked? No - do NOT sell products that are trademarked. For example, in the video, Sarah compares two items - one that is a generic self-stir mug, and one that is a self-stir mug with Harry Potter imagery on it. Do NOT sell the Harry Potter mug, as it is illegal. If you sell products with trademarks, you aren’t just risking getting sued - you’re risking having legal action taken against you.
