Medicare is the social service of state of California that pays for some very basic dental services, maybe Medical in other states is called Medicaid. I think that's what you mean, which is basically for low income families or minors as far as I know. No Medical or Medicaid does not pay for dental implants. Medicare is the medical reimbursement system of the country that's federal and in very very rare cases where one can make a case that getting the implants is necessary for rebuilding the jawbone, one can make Medicare pay for it. However, if you're missing a tooth and you think Medicare is gonna pay for the dentistry, it's not going to. If you just have dentures that are not holding that well and a couple of implants will do to addition of denture, 99% Medicare is not gonna pay for it. if however there is so much bone loss, so much infection that it's, you know, the condition will look more like a medical condition than a dental condition there is a chance. But the dentist who does that should have training in coding for Medicare because the coding for Medicare and medical insurance is totally different from coding for dental insurance. Medical billing for instance they don't call it implant they call it fixture, so it's it's totally different. If you go to a regular dental office who does not have this training you're not going to get paid anything but overall. As I said don't think about I don't want to I don't want you to hope that Medicare would pay for your dental implants, they won't. If your condition is that severe that there is a chance they do pay for it then your dentist will advise you on that.

Government agencies require repayment of some or all of the money they lay out for your health care after a personal injury. When your settlement dollars come in, you need to consult a lawyer to figure how exactly how much you owe to each agency. In other videos, I've talked about liens and subrogation interests, which all involve someone else trying to get their hands on your settlement proceeds after your case is resolved. If you missed those videos, then you might want to go back and watch them, as well. Liens, subrogation interests, and reimbursement rights are all related. The common denominator is YOUR MONEY. Today, I want to talk about those government agencies that also want to get their hands on some or all of your settlement proceeds. This video is for anyone with Medicaid or Medicare or any other government health insurance program. If you don't take advantage of any of those benefits, then feel free to click STOP and go to one of our other educational videos. If you have Medicare or Medicaid, however, you need to know that they have a statutory right—which means a CLEAR, LEGAL right—to get repaid out of your settlement...for ANY amount they paid on your behalf. Now for the complicated part: Each of these agencies gets paid back in different ways, sometimes with very different sets of rules. Here is some basic information though: MEDICARE. Since it is a federal program, MEDICARE gets paid FIRST out of the settlement. As a general rule, MEDICARE must reduce their lien by 1/3 for attorney fees , but otherwise they have the right to full repayment. If you have a very large settlement and only a small MEDICARE lien, then this will be easy to resolve. However, if you have a small settlement, but a very large MEDICARE lien, then you can have a real problem on your hands. MEDICARE can gobble up ALL of your settlement proceeds before anything else is paid. Unfortunately, we run into this situation regularly. In an attempt to reduce the amount repaid to MEDICARE, quite often we have to resort to certain appeals for a waiver or reduction of the lien. MEDICAID in NORTH CAROLINA has a different set of rules. They get in line behind MEDICARE in order of priority. If you have MEDICAID, then, as a general rule, they get treated the same as a "valid lien holder." This means that North Carolina Medicaid, together with the other valid lien holders, cannot get more than approximately1/3 of the settlement proceeds, no matter what amount they paid in your case. Some of you may have both MEDICARE and NORTH CAROLINA MEDICAID, in which case the situation can get exponentially more complicated depending on the amounts paid by these agencies, the amount of settlement of your case and the amount of outstanding bills. Unless there is plenty of money from the settlement to pay all of these agencies back, then I strongly encourage you to talk with legal counsel to get some assistance. You absolutely want to make sure that you pay these agencies back correctly, one because they can stop future benefits if you don't, and two since they are the government, they have the ability to come after you civilly or even criminally under the law if you stiff them. We have focused today on the two major government health insurance plans of Medicare and Medicaid. Virginia Republicans Broke Into Governor's Office To Block State's Medicaid Expansion On June 15, without the permission of administration officials or the Virginia State Police, House Speaker William J. Howell (R) enlisted the Capitol Police and clerks from the office of the House of Delegates to break into Gov. Terry McAuliffe's (D) secure office suite to deliver the state budget when the governor was not around. The break-in was part of an ongoing effort by Virginia Republicans to block McAuliffe's promise to expand Medicaid in the state. The state budget, which has served as the center point of the political battle, contained several contentious provisions barring McAuliffe from expanding the health care program. Howell decided to have the state budget delivered to McAuliffe's office on Father's Day, ahead of the document's expected delivery frame, even though the governor's staff made clear no one was around. Since the governor is bound by a seven-day window to sign or veto the legislature's budget, the plan's delivery may shorten the amount of time the governor has to review the legislation. The Richmond Times-Dispatch reports: Administration officials said the House had told them not to expect the budget before early last week. When representatives of the House contacted the administration that Sunday, Father's Day, House emissaries were informed that nobody would be present at the offices to receive the document. How Medicaid & Obamacare Hurt the Poor - and How to Fix Them
"Most physicians can't afford to accept Medicaid" patients, says Dr. Alieta Eck, a primary-care physician based in Piscataway, New Jersey. "If you're getting paid about $17 per visit, it won't be long before you can't pay your staff or pay your rent." Medicaid is the nation's health care system for the poor. It's funded jointly by the federal government and the states. Medicaid is either the first- or second-largest budget item in all 50 states and the program is slated for a massive expansion under President Obama's health-care reform law. Despite the program's huge and growing overall cost, reimbursements to medical providers are so low that many practices refuse to accept Medicaid patients, causing long waiting periods for treatment. Eck and her husband, Dr. John Eck, are the founders of Zarephath Health Center, a free health care clinic in Somerset, New Jersey, where they each volunteers six hours per week taking care of poor patients. While the Ecks don't accept Medicaid in their private practice, some of the patients that show up at their free clinic are Medicaid recipients who can't find a regular doctor. "The hardest thing for a Medicaid patient to do is get a doctor's appointment," says Avik Roy, who writes a health care blog at Forbes.com and is a senior fellow at the Manhattan Institute. One consequence is that Medicaid recipients show up at emergency rooms at nearly double the rate of the privately insured, often with accute problems that could have been addressed earlier in a doctor's office. They're also more likely than both the privately insured and the uninsured to have late-stage cancer at first diagnosis. After they've been diagnosed, it's also difficult for Medicaid patients to find qualified surgeons who will treat them. A University of Virginia study found that Medicaid patients were about twice as likely as the privately insured to die in the hospital after surgery. Even the uninsured were more likely to make it out of the hospital alive than Medicaid patients. Despite the program's failings, in 2014 Obamacare will add millions of new patients to the program's rolls. "All too often, people who claim to care for the poor say, 'I'm going to give you a card that says you have health insurance and my work is done,'" says Roy. "But the hard part is making sure that person gets treated." Obamacare was designed to expand Medicaid by about 17 million enrollees by 2021, but it likely won't meet that goal because the Supreme Court ruled that states don't have to participate in this component of the law in order to keep current levels of funding. So far, the governors of 19 states have come out against expanding Medicaid in their states. So what's the best way to provide quality health care to the poor without spending more money that we don't have? Roy says the federal government should take the same money it spends on Medicaid and block grant it to the states so they can experiment with health care plans in which the patient is in control. "Let them spend it on the doctor of their choice," says Roy. "Let people take the money and get the bureaucrats out of the way, and you'll find there's suddenly a lot more efficiency in the way people actually get health care." Eck believes charity care could be a big part of the solution, if only the government made it easier for doctors to volunteer their time. She has worked with state Sen. Robert Singer (R-N.J.), who has co-sponsored a bill in New Jersey that would allow the state to cover physicians for malpractice in their private practices as a way of compensating them for volunteering. The bill is currently awaiting consideration by the state senate's health care committee. "Every doctor I talk to says, 'I would do that in a heartbeat,'" says Eck. In the meantime, when Obamacare takes full effect next year, charitable clinics like Eck's will be more essential than ever to pick up the slack for a social safety net that's already not working. Can Gov. Terry McAuliffe Bring Medicaid To Virginia On His Own?
Virginia Attorney General Mark Herring said it isn't clear how or if Gov. Terry McAuliffe will be able to legally expand Medicaid, or improve upon the state's health care, on his own. Herring said Friday on the Kojo Nnamdi show he thought McAuliffe was "doing the right thing fighting for" Medicaid, but would have to review the forthcoming proposals from McAuliffe and the state's Secretary of Health to determine whether they'd pass legally under the governor's executive power. A poll out of Roanoke College last week showed a state deeply divided on the issue, with 46 percent of those surveyed saying they don't want the system to change and 41 percent hoping for reform. Twelve percent were undecided. But even fewer--28 percent--are comfortable with the idea of McAuliffe taking action on his own, without a vote from the state's legislature, The Daily Press reported. Failure to reach an agreement on Medicaid prompted a budget standoff as the session came to a close; the plan was eventually passed without a measure to broaden the plan's reach. Republicans have said they'll reconvene the House and Senate in late September to debate the issue again. Watch McAuliffe discuss the issue below. Well, we already know the answer. Just ask America’s veterans—they’ve had government-run health care for decades. The U.S. Department of Veterans Affairs (known as the VA) runs the largest hospital and health care system in America. The VA employs over 340,000 people—twice the size of the Marine Corps. And it has a $180 billion annual budget, making it the second largest department in the Federal Government. Only the Department of Defense budget is bigger. The VA is a true single-payer health care system. It runs over 150 hospitals and 1,400 community-based clinics across all 50 states. The doctors, nurses, administrators – everyone that works for the VA – is a government employee. The system actively serves some 7 million patients—one-third of the 21 million veterans alive in the U.S. today. Sounds impressive, right? But for the past few decades—and especially for veterans of the war in Vietnam, as well as the wars in Iraq and Afghanistan, where I served—the VA has been an abysmal failure: inefficient, bureaucratic and sometimes deadly. Among veterans, horror stories about the VA abound. These stories were tragically brought to light in 2014, when whistleblowers in Phoenix revealed that 1,700 veterans there had waited an average of 115 days just to receive an initial appointment. According to the VA’s official policy, that wait time should have been no more than 14 days. As if that wasn’t bad enough, the Phoenix VA then lied about it, releasing falsified waiting lists to the public to cover its tracks. Phoenix turned out to be the norm, not the exception. The VA’s inspector general found systemic problems across the country. In Fort Collins, Colorado, for example, clerks were instructed to falsify records to show that doctors were seeing more patients than they actually were. In Columbia, South Carolina, delays in diagnosis and treatment directly led to the deaths of multiple patients. The VA program there had nearly 4,000 backlogged appointments despite a $1 million grant earmarked to reduce delays. And in the VA’s hospital in Pittsburgh, in 2011 and 2012, there was an outbreak of Legionnaires’ Disease that officials knew about for more than a year before informing patients. At least six veterans died as a result. The Obama Administration’s own Deputy Chief of Staff, Rob Nabors, revealed that VA health care has a “corrosive culture” with “significant” and “systemic failures.” The politicians’ response to this debacle? Spend more money -- a lot more money. The VA’s budget has almost doubled since 2009. They’ve hired 100,000 new people in the past decade. A showdown over Obamacare's Medicaid expansion pitting Republican lawmakers against Virginia's newly elected governor is almost certain following the GOP victory in a drawing to decide control of the state's House of Delegates. The expected fight in a purple state demonstrates the law's staying power even as a Republican president and Congress work to undo it. Gov.-elect Ralph Northam campaigned heavily on expanding the state's Medicaid program and has made it a top priority. But Democrats' inability to gain a 50-50 split in the state's lower legislative chamber on Thursday means they will need Republican defectors to back a plan, as well as figure out how to pay for its share of costs. Republicans also maintain a narrow 21-19 majority in the state Senate. “I think there is a real possibility, because you’re talking about one or two people in each House,” University of Virginia politics expert Larry Sabato said after Democrats’ strong electoral performance in November. It's unclear whether Democrats will challenge Republican David Yancey's win to represent Virginia’s 94th House District, which gave the GOP a 51-49 majority in the House of Delegates. Democrats’ prior attempts to expand Medicaid — pushed every year by outgoing Gov. Terry McAuliffe — were repeatedly rebuffed by what had been strong GOP legislative majorities. The calculus changed after Democrats nearly flipped control of the lower chamber and held on to the governorship in the state's off-year election. Virginia is one of 19 states that haven't adopted the Obamacare expansion, which allows individuals to qualify for Medicaid if they have incomes up to 138 percent of the federal poverty level, or roughly $16,600 for an individual. Nearly all of the holdout states are led by Republican governors. Expansion of Obamacare coverage is anathema to many Republicans in the Legislature, although lawmakers in the state Senate are generally less conservative than their counterparts in the House of Delegates and are not up for reelection until 2019. Medicaid expansion would cover roughly 400,000 low-income adults in Virginia and has the backing of the state’s hospitals and advocacy groups. “Come hell or high water, we will do everything in our power to make sure this gets done,” House Democratic Leader David J. Toscano and Caucus Chair Charniele Herring said in a joint statement after McAuliffe included Medicaid expansion in his final budget proposal. Northam is also likely to feel pressure. The former state senator and lieutenant governor angered liberals after a Washington Post interview in December during which he sent mixed signals about how aggressively he would push the expansion during the legislative session that starts on Jan. 10. He later issued a statement on Twitter insisting he will advocate for the plan, adding “it is a no-brainer for Virginia families, our budget, and our economy.” “He campaigned on it all year. If he doesn’t deliver on it, he’s going to have a problem,” said incoming Virginia House of Delegates representative Lee Carter, a supporter of single-payer health care who backs a “clean” Medicaid expansion, without features favored by some conservatives like higher costs for enrollees or work requirements as a precondition for receiving benefits. Northam, Carter said, “appears to want to come to the table with a compromise position already. But we’ve seen what happens on the federal level when you do that, which is that the other side just demands more compromise. From my perspective, you come to the table with your wish list.” Virginia would also be aiming to expand its program at a time when states must cover more of its costs. The federal government paid the entire cost of covering new enrollees for three years, but states began contributing 5 percent in 2017 and will have to pay 6 percent this year. Some states have already wrestled with coming up with those funds even though the federal government continues to cover the vast majority of the costs.

In the Weekly Republican Address, Virginia Gov. Bob McDonnell marks the unfortunate one year anniversary of the passage of Democrats' unpopular health care bill and discusses the burdens it places on states. Gov. McDonnell says, "Unlike states, families, and businesses, the federal government doesn't have to balance its budget. And that unfortunate reality leads to policies like the federal health care bill that push expensive, unfunded, and unsustainable programs onto the rest of us. Washington passes the law, and then expects us to balance the books." He explains, "The law shifts billions in unfunded mandates onto state governments, and rigid new requirements restrict the governors' abilities to manage our state programs. The result: higher costs, less innovation and freedom. That's a prescription for serious problems at the state level, where much of this plan must be implemented. Most notably, the federal health care bill dramatically expands Medicaid, which was already growing at unsustainable rates." And, Gov. McDonnell adds, "The federal health care bill is not only a budget buster, it's also unconstitutional. Virginia, like the majority of states, is challenging this legislation in court. Already a federal District Court judge has ruled in our favor, concluding that the provision that a Virginia citizen must purchase insurance or face a penalty is unconstitutional.... The legal issues must be settled promptly by the [Supreme] Court to create certainty and finality for health care providers, businesses and all Americans. Shockingly, the Obama Administration opposes an expedited appeal to the Supreme Court, preferring the potential for years of costly litigation in the lower courts." He concludes, "We need policies that give greater freedom to citizens and employers and don't overly burden states and businesses. Policies that recognizes what history teaches well: and that is that the creative solutions of the free market beat one-size fits all plans of big government. Here in your state capitols, Republican Governors are leading the effort to cut government spending, keep taxes low, help the private sector create jobs, provide access to affordable health care and get our economy back on track by making our states more competitive.
