Ways to Avoid Making the Judge Angry in a Family Law Case

The main thing you can do this is to be reasonable in what you are asking for. Deciding what is reasonable is, I know, sometimes hard to gauge because this is your life, this is your children, etc. When you're really biased it's hard to see the other side it's hard to see the other side as being reasonable but to the best of your ability when you're going through a case when it comes to whatever request that you're making or whatever position you're taking I think that you should always put your self in the position of the judge. The judge is ultimately is the most important person in your case. I recently had a couple of different cases where a judge thought that my clients positions are unreasonable and in one case my client didn't see where his position was unreasonable and the judge actually punished him pretty severely. In one case we had a temporary orders hearing and it was like in November of 2015 and as a result of the temporary orders hearing our judge ordered my client to be responsible for paying the car payment on the family vehicle as well as the car insurance on the family vehicle until the time the final hearing came around. so what happened was soon as we were waiting for the final hearing the car tags came due on the family vehicle and my client wanted his soon then soon-to-be ex-wife to pay half the tags she didn't have a job she wasn't working she didn't have full-time access to a vehicle because they were sharing one vehicle and he worked full time so she that she pay for half the tags. So ultimately my clients decided not to pay for the tags even though he had been ordered to pay for all other expenses related to that vehicle. The judge got really upset with him at the final trial because he didn't pay for the registration on that car and he was the one that was earning the money and he had the means to do so and the judge punished him in and this the fact that he didn't pay for the tags came up at least three times in the final minute entry in the judge really let my client have it in other areas. The judge thought the tags were a big thing in this case she brought it up over and over and over again that he was unreasonable his conduct of not just simply paying for the tags was unreasonable by the way she also said that the wife's conduct of not responding to my clients request to pay the tags was also unreasonable. So that's one example of of how things can go really bad if in the judges eyes you're being unreasonable The worst part in that case is however that my client has been ordered to pay a portion of the now ex-wife's attorneys fees and costs and is due in part to judges perception of my clients and reasonableness. Sole Custody vs Termination of Parental Rights

http://commandthecourtroom.com The difference between sole custody & terminating the parental rights of the other party. What I mean by this is one party having sole custody or decision making vs that party terminating the other parent's rights. Let me tell you where this is coming from. Over the last couple of days I had a father come in to see me and he has spent a year long battle with his ex-wife over their children. They fight like cats and dogs about everything and right now they are going through a custody battle and the father is just plain tired and ready to give up. He was considering just giving her all rights to the children. So, I need to clarify what he meant because when someone says to me that they want to give up all rights of their children then that potentially means having their rights as a parent terminated. That is a big step. Having rights severed means that as a parent you will never again get to see your children. You won't have rights to parenting time or making decisions in your children's lives. Your rights are terminated and if somebody else comes along and wants to adopt the children. For example if your ex gets a new spouse and they want to adopt then that can happen. In this particular case after I explained to the client that giving up all rights could potentially mean termination of his rights, he understood that is not what he wanted to do. What he wanted to do was just hand over custody rights and parenting time rights so that she would have all say over decision making and that he wouldn't even have parenting time. The client was also under the false impression that if he did that, he would no longer have to pay child support. In a case where rights haven't been terminated, then I explained that at least in Arizona, that he would definitely have to pay child support even if wasn't seeing the kids or making decisions about them. So either way he was going to have to pay child support so he had to make the decision whether he was going to pay child support and not have any involvement in the kid's lives. Or pay child support and try to be involved. As a side note to that, if you're considering terminating your parental rights or terminating the other parent's rights, you really need to check with the laws in your state and jurisdiction to find out if termination of parental rights means that the obligation to child support is stopped. So like I said, in Arizona a person is not off the hook for paying child support if they agree to termination of their parental rights unless another party comes along and adopts the children. How Does an Affair and Adultery Affect a Divorce in Ontario?

Adultery Laws in Ontario: If your marriage ended due to an affair, extra marital affair, or "cheating" this question is likely at the front of your mind: What impact will infidelity have on a divorce case in Ontario? Ontario's divorce laws are the same as every other province, as they are all governed by the Federal Divorce Act. Adultery and Grounds for Divorce That Divorce Act says that a "breakdown of a marriage is established only if the spouses have lived separate and apart for at least one year or the spouse against whom the divorce proceeding is brought has committed adultery or treated the other spouse with physical or mental cruelty." This means adultery is grounds for a divorce. Adultery and Alimony Infidelity has no impact on how Canadian alimony is structured. Things like child custody, child support, spousal support, and property division are all no-fault in Canada. This means if you have been cheated on you're not entitled to any more alimony, nor do you have to pay anymore if your infidelity ended a marriage. Adultery and Child Custody Section 16(9) of the Divorce Act specifically precludes the consideration of the past conduct of a parent in making a custody or access order, unless that conduct is relevant to the person's ability to act as a parent to the child. A history of violence can affect child custody under Canadian law, however, adultery will not. In summary, the no-fault nature of most of the aspects of Canadian divorce laws may not be what you're expecting. The way divorce is portrayed in American television and film might skew what to expect when a marriage ends from adultery. Failing to Appear in Court in a Custody or Divorce Case

It's never a good idea to not show up for your court hearing in your divorce or custody case. Especially if you have an interest in what the outcome might be. Now if you don't have an interest in what the outcome might be meaning you don't care one way or the other it's still not necessarily a good idea not to show up. A lot is going to depend on what type of hearing that you are not showing up for. In some cases if you don't show up for your family law hearing what the court could do is enter what is called a default judgement against you. What that means is that the court could give the other party all the relief that they are asking for. If the other side is asking for sole custody or sole decision making and their asking to have the majority of the parenting time or they are asking for some outrageous of child support, it is possible that that person could get those things. Especially if you don't show up and make your case and defend whatever it is that you want. So that's one scenario. Another scenario could be that the court could make orders against you that really prejudice you that is not based in fact or that the other party made up and as a result it could affect your life down the road. A while back I once represented a man in his divorce proceedings and at some point we parted ways and he decided to represent himself. What he ended up doing was not showing up at a very important court hearing and the court entered orders against him for ridiculously high amounts in spousal maintenance on a monthly basis. We are talking like $6,000 a month. My former client continued to miss court hearings and continued to ignore the court orders and before everyone knew it, he had amassed in arrears in the amount of $45,0000. And he continued to ignore the court's orders. What the judge did was issue a civil arrest warrant for him and he was actually arrested and went to jail. He was a good person, a good father, had a well paying job, he was very intelligent so I am not really sure why he made the poor decision not to show up. He was put in jail for this huge amount of arrears and the court set a really high purge amount before he was able to get out of jail. What that means is he had to pay tens of thousands of dollars for the judge to release him. Somehow he was able to get the money so he was able to get out of jail but it was a really hard lesson for him to learn. So one, he had pay these these large amounts of alimony and ended up in jail. It is really difficult if the court has entered it's orders and you don't show up in court unless you have a good excuse to get the judge to change the orders or set aside the orders. I've seen people who ignore the court's orders and they suffer some terrible consequence and they decide they want to do something about this and change whatever it is that the judge previously ordered but at that point it is too late. Because they had their opportunity to be heard and have their say and they just didn't take it. So I really want you to think carefully before you make the decision to just not show up in your case. Even if you have decided you don't care if the other person gets what they want, think about entering an agreement with that other person. But my advice is don't just not show up for your custody or divorce hearing without letting the judge know you have come up with an agreement. But if you don't have an agreement, then by all means show up in court and defend your position. The Up-trending Interest in Mediation Before we talk about the next family-friendly separation and divorce option, let’s first clear up the major problem when it comes to lawyers... In our years of practice, we have been fortunate to work with some really amazing lawyers. Unfortunately, we have also dealt with a number of less than savory ones. The one thing they all have in common though it that lawyers have a profit motive. This is not an indictment, it is a simple fact. Don’t get me wrong, there are many excellent, honest and dedicated members of the family law bar and it has been my privilege to know quite a few of them. But every one of those straight-talking lawyers can tell you horror stories about other lawyers. Even if you hire the most virtuous lawyer available, the other side might hook up with a barracuda and your legal fees will be astounding. It is always better to engage a single, neutral professional and work it all out without paying a number of lawyers to fight. Mediation – The Path to an Amicable Divorce Mediation is a non-adversarial, future-focussed, problem-solving process. It is not about assigning blame. It is a creative process that allows you and your spouse to work with a neutral third party to find the path to an amicable divorce for you and your family. Normally, lawyers do not attend the mediation sessions. However, you can review the separation agreement with a lawyer prior to signing it. Usually this is the best way to minimize the cost and pain of divorce. How could the decision to mediate be so easy, but at the same time so difficult? The answer is simple. If you merely want to be a passenger and have the issues of where you are going, the route you will take, the speed you will travel, and how long and hard you will drive, decided by someone else, then maybe mediation isn’t for you. If you have the courage to take charge of your separation, and the smarts to make your own decisions on how you will live your life, you are a good candidate for mediation. An amicable divorce is usually not achieved in a lawyer’s office, nor is it achieved in Family Court. The best way to achieve an amicable divorce is to settle amicably, through mediation. MARY AND PHILIP SEEMAN HEALTH LAW, POLICY & ETHICS SEMINAR November 22, 2018 presents: Josephine Johnston, Research Scholar, The Hastings Centre Genetics, Parents and Children: How Novel Technologies Challenge Ideas about Parental Responsibility Advances in genetic technology, including new methods for gene editing, promise to provide parents and prospective parents with more information about and more control over the genetic make-up of their children. Information and control are both highly prized in our culture, and both could offer substantial benefits to parents and children. Yet offers of information and control that promise to benefit children can quickly generate new parental responsibilities, morphing from opportunities to obligations, and raising the question whether refusing to use the technologies—in the case of gene editing, refusing to edit a prospective child’s genes—might one day be considered inconsistent with being a “good parent.” In this presentation, I will explore the idea of the good parent and will argue that our understandings of the “good parent” need to evolve to take parents’ own flourishing into account. Only with this richer understanding of the responsibilities of parenting can we adopt technologies like gene editing in ways that benefit both parents and children. Josephine Johnston is Director of Research and a Research Scholar at The Hastings Center, an independent research institute in Garrison, New York. A lawyer by training, she works on the ethics and policy of emerging biotechnologies, particularly in human reproduction, psychiatry, and genetics. She is co-editor of Human Flourishing in an Age of Gene Editing (Oxford University Press, 2019). In addition to her scholarly articles in leading medical, science, policy, law and bioethics journals, she has written for Stat News, New Republic, Time, Washington Post, and The Scientist, and is frequently interviewed by journalists, appearing in the New York Times, Wall Street Journal, The Guardian, Wired, and Vice Media and on ABC’s “Nightline.

Seattle Divorce Property and Asset Division - Seattle Divorce Attorney Amanda DuBois

http://www.duboislaw.net/Dividing-Property/ Today we want to talk about property and asset division in a Seattle divorce. How is property divided in a Seattle divorce and what can you do to assure that everything is properly accounted for and you get your "fair share" so to speak? You need to begin by creating a Divorce Spreadsheet, and listing all of your marital assets as well as anything that can be classified as a separate asset - in other words, did either party own something of value prior to getting married that was not purchased with community money. Did you husband or you own a car previous to marriage? That would be a potential example of separate property. On your spreadsheet, we need to account for the asset, whether commmunity property or separate property, define the value of that asset and then define any debt on that asset in order to arrive at the net value of your assets. So this means if you own a home together, you are going to need to get it appraised. If you have cars, you need to determine their value by going to a source like Kelly's Bluebook. How about savings accouts, checking accouts and the value of any retirement plans held by either party? We need to account for those assets also. Is there a business involved, how about business assets, valuation of business, cash on hand and in the bank, etc. This information needs to go on your divorce spreadsheet. Now how about unsecured debt? Do you have credit cards and balances owing, all of this is taken into consideration when you get to court. It is critically important you have as accurate a picture as possible for your finances as the courts will use this information. The Seattle Divorce courts will use this information in making their determinations in your Seattle Divorce. In Washington, all property generated by the two parties during the years they were a couple is generally considered community property (or marital property) and is up for division. This includes retirement account benefits. The law in Washington (and thus in your Seattle Divorce case) starts with an assumption that community property will be split 50-50. However, from there the court will consider a variety of factors that could lead to different percentages. For example, when one party is the higher wage earner, the courts may attempt to put the parties in a closer economic position after the divorce through property division and spousal maintenance. Fifty/fifty is just the starting point. There are various legal factors that can tip a property distribution in favor of one spouse. You had better be sure you have an attorney who has enough experience in the courtroom to know how judges are viewing property distribution, so you can get the best possible result in your Seattle divorce. When you have an action for divorce in Nassau and Suffolk County, or in fact in any county in New York State, the court requires that parties go through a process of financial disclosure. Sometimes this sounds silly to people because they think since they lived under the same roof, they know each other’s financial dealings and holdings. It’s not often the case, especially if somebody has a business or profession and the other spouse is a stay-at-home mom for example. Sometimes things are not known between the parties that need to be disclosed. In the end, we are going to be dividing assets, setting child support and spousal maintenance potentially based upon income and assets that the other side may not be completely aware of. There is a form called the statement of net worth that is a court promulgated form that is required by the courts to be submitted by both parties. It’s in the form of an affidavit actually. It gives family data; it provides basic information about monthly expenses, income, assets, and liabilities. It’s a thumbnail sketch, basically, for the court and the other side to understand what one side has or one side needs. It is routinely filed with the court and is also exchanged with the other side so that both parties start with an equal pool of information about the finances of the marriage.

Ontario Furniture 7 Foot Folding Bench

I just got this great bench from Ontario Furniture. This is made of that very durable plastic made to make folding tables. So it is really durable and well made. The legs are made of durable metal materials. This is pretty easy to set up, just unfold (it folds in half), and then the legs and secure the metal brackets to hold them open. This one also has a strap you can use to carry the bench when it is folded up. I noticed you need to push down on the joint to secure it and lock it in place. Makes a very nice bench. The height when folded out is 17 inches. It's a good size, hits adults right at knees kids it might be a little tall for small children but my six year old had no problems sitting on it and neither did I or my 14 year old. It's 10 inches deep and 7 feet long. So you can actually sit a bunch on this one bench. I got this to use at my office. I have a wall that I needed a seating area for kiddos. I think this will fit perfect and it's durable enough to handle kids. Very well made and durable. I received this item complimentary or at a reduced price for my honest review. Commercial Cases: Commercial mediation, as practiced by mainstream litigation-oriented mediators, can feel like either a silly game or an all-out war to the clients involved. Only lawyers find spending the day in separate rooms, being manipulated by a retired judge, to be in any way meaningful or rewarding. Transformative Mediation, on the other hand, provides procedural justice. Simon Mediation supports clients in addressing their dispute in the most meaningful way possible. Partnership Disputes: Transformative Mediation provides the greatest likelihood that partnership disputes, or conflicts within closely-held corporations, can be resolved efficiently and to the satisfaction of all concerned. If Simon Mediation is employed early, we can eliminate the need for legal fees. If we're brought in later, we can put an end to the attorney fees and can quickly and efficiently reach a mutually satisfactory resolution—real results that all parties can live with. Simon Mediation is also successful at salvaging partnership relationships that were on the brink of collapse. Transformative mediation demonstrates that resolution can be reached even more efficiently if it’s handled in a way that respects everyone’s perspective. Those are the days we would turn the water on and mom and dad would leave it on forever and just let the toothpaste go there. Well we conserve a little better than that now. Baby teeth need to be brushed. Dr. Long: Yes so even though they will fall out, baby teeth serve a lot of functions. The number one being that it's important to the nutrition. So if baby's teeth are not healthy then... Charlie: They are not eating. Dr. Long: They cannot eat with it. So that's number one. Number two is because the teeth are there it does help with the development of the bone, of the jaw bone. And if we lose the teeth too early then the jaw bone will not develop. It may not be important in the sense of the baby teeth themselves but to the adult teeth. The baby teeth prepare the arch, prepare the bone. Charlie: What's going on around here, so then the shape...? Dr. Long: Yes. It's really preparing it for the adult teeth that are coming in. For phonetics, for speaking as well so if a tooth is missing or many teeth are missing, we may have some speech issues and there are self esteem issues as well. Believe it or not, kids do have self esteem issues. Charlie: Oh yeah. Dr. Long: If a child has a lot of cavities they may not smile as much they may not smile in pictures and stuff like that and they may feel they are somehow different and it does affect the development of the child. If you haven't seen that one you have to go see that one. Yes we have to make sure these baby teeth are brushed. Dr. Long: Yes. Dr. Marc: Dr. Julie we're talking about baby teeth but clearly there's money in these teeth, you have to protect them because otherwise how are you going to trade them with the tooth fairy to get paid? But clearly there are more serious reasons than that. Dr. Julie: Yes. You want to start good oral hygiene habits early on. Kids strive in routine so you start very early on they won't remember but as they get older they'll always remember oral hygiene being a part of their routine and you want to install it very early on so that they can carry on in life having that in mind. Dr. Marc: That's great, so in a way these are almost like practice teeth. You want to really get good at practicing and taking care of these because those are the habits that are going to help you with the ones you have to keep for a long time. Dr. Julie: Parents need to practice also to brush the baby's teeth because we're used to it. When you have a baby for the first time it's almost scary what you have to do with the teeth, how to brush them. Do it very early on... Dr. Marc: And you recommend coming in with those first two teeth have kind of erupted and that's the time to really jump in there and start caring for these teeth, right? Dr. Julie: Yes, definitely and it's easier to brush two teeth than more. Dr. Marc: Good point. Yes, practice with two before you have a whole mouth full. . . . . .
