This in on 8-2: - DEPARTMENT STRESSES STATE REGULATORY re ASSOCIATION HEALTH PLANS - On August 2, PA Insurance Commissioner Altman sent letters to HHS Secretary Azar and U.S. Department of Labor Secretary Acosta addressing concerns PA has about President Trump’s rule on Association Health plans (AHPs) which takes effect September 1, 2018.   The core concern is that an association may provide for health insurance for its members ONLY if it meets PA legal requirements of organizing for purposes other than insurance and has been in existence for at least two years.  In addition, AHPs must be fully insured using an insurance entity which has a certificate of authority to do business in the Commonwealth.  Her letter also made the following points: - A sole proprietor is part of the individual insurance market and is not an employer for purposes of health insurance coverage. - An AHP is actually a Multiple Employer Welfare Arrangement (MEWA). - Policy forms, rates, solvency and insurance broker licensing requirements for both in-state and out of state insurance producers are regulated by state law. - Short-Term Medical (STM) in 60 days will become Short-Term Limited Duration Insurance (STLDI). No longer an 89 day maximum limit per policy. Now policies can be written for a period not to exceed 364 days. 2019….STLDI will be a big player IF Pennsylvania doesn’t put up any roadblocks. Agents and Carriers must advertise a comprehensive disclaimer making sure these plans are NOT sold as ACA and that the consumer understands the program fully. MD, VT, HA, VA all passed state legislation limiting sales to less than three months. - 2019 FFM Certification: AHIP and MLMS. AHIP and MLMS are both available. Trump Administration: Open Enrollment for Individuals starts TODAY. The Direct Enrollment Pathway is no longer disabled. Commission flyer is attached. UPMC may have quoting issues. Resources are: healthcare.gov and/or URL’s quoting site and/or the carrier sites. Pre-X – Waiver programs: Don’t believe the hype. For those states that are considering filing for waivers, a secondary market would be set-up for those with medical conditions. However, the goal is to expand offerings within the states that have an approved waiver so that insureds have other more affordable options, if eligible. Another aspect of the Section 1332 changes would include expanded use of HRA funds to use in paying STM plans, Individual plans, Carry-over provisions, etc. Comments are due December 28th. Proposed New Rules: The use of Federal Subsidies for skimpier plans that can reject those with Pre-x. Please note that provisions would still be in place for those WITH pre-x conditions for any states that may embrace these proposed rules. Additionally, the use of HRA funds to employees to obtain individual plans. This would be in addition to the QSEHRA provisions that are already in place. PA House Bill 504 was signed into law. This allows for an unlicensed entity to sell contents insurance for storage companies as long as the owner or manager has a limited license. US District Justice in Texas heard oral arguments in Texas v Azar challenging the constitutionality of the ACA law since the Individual Mandate has been zero’d out. Provisions include prohibition on recissions, extension of dependent coverage. prohibition of preexisting conditions, tax credit for small business employee health insurance expenses, payment for bone density tests, misvalued codes under physician fee schedule, elimination of co-pays, incentives for prevention of chronic diseases, immunizations, nursing student loan repayment, financial assistance for primary care physicians, and expansion of primary care. A group health plan and a health insurance issuer offering group or individual health insurance coverage shall not rescind such plan or coverage with respect to an enrollee once the enrollee is covered under such plan or coverage involved. A group health plan and a health insurance issuer offering group or individual health insurance coverage shall provide preventive care and screenings to infants, children, adolescents, and young adults. A group health plan and a health insurance issuer offering group or individual coverage shall continue to make such coverage available for an adult child (who is not married) until the child turns 26 years of age. A group health plan and a health insurance issuer offering group or individual health insurance coverage may not impose any preexisting condition exclusion with respect to such plan or coverage. An eligible small employer, the small employer health insurance credit amount is 50 percent (35 percent in the case of a tax-exempt eligible small business). For purposes of identifying potentially misvalued services pursuant to clause (i)(I), the Secretary shall examine (as the Secretary determines to be appropriate) codes (and families of codes as appropriate) for which there has been the fastest growth; codes (and families of codes as appropriate) that have experienced substantial changes in practice expenses; codes for new technologies or services within an appropriate period (such as 3 years) after the relative values are initially established for such codes; multiple codes that are frequently billed in conjunction with furnishing a single service; codes with low relative values, particularly those that are often billed multiple times for a single treatment; codes which have not been subject to review since the implementation of the RBRVS (the so-called `Harvard-valued codes'); and such other codes determined to be appropriate by the Secretary. Elimination of coinsurance (co-pay) on preventive services (ie. physical exams) in outpatient hospital settings. Incentives for prevention of chronic diseases. A program described in this paragraph is a comprehensive, evidence-based, widely available, and easily accessible program, proposed by the State and approved by the Secretary, that is designed and uniquely suited to address the needs of Medicaid beneficiaries and has demonstrated success in helping individuals achieve one or more of the following: ceasing use of tobacco products, controlling or reducing their weight, lowering their cholesterol, lowering their blood pressure, avoiding the onset of diabetes or, in the case of a diabetic, improving the management of that condition. The Secretary shall establish and carry out a pediatric specialty loan repayment program under which the eligible individual agrees to be employed full-time for a specified period (which shall not be less than 2 years) in providing pediatric medical subspecialty, pediatric surgical specialty, or child and adolescent mental and behavioral health care, including substance abuse prevention and treatment services. President Moon Jae-in introduced his ambitious health care reform plan early this month. (Korean) August 9, 2017 "From the latter half of this year until 2022, I will make a country where every single person is free from medical expense concerns and is treated of any disease without any worries." ( 2022 , .) The ultimate aim is to have no medical treatment left uncovered by the national health insurance... except for some cosmetic procedures. The national health insurance will start covering a number of services patients had to pay 100-percent for -- like MRI scans, ultrasounds, and robotic surgery. The government will also cap medical spending based on households' yearly earnings... with the national insurance agency bearing the extra amount. The government plans to pour 30-point-6 trillion won, or 27 billion U.S. dollars, into this,... with the money coming from the accumulated profits of national health insurance and the government budget. While this is expected to cut average medical expenditure by 18-percent... and for low-incomers, by 46-percent,... it will also raise Korea's national health insurance coverage rate to 70-percent by 2022 from the current 63-point-2 percent. Korean households bear almost 37-percent of their medical expenses... the second highest in the OECD, following Mexico. The OECD average stands a bit below 20-percent. (Korean) "The national health insurance covering ALL medical treatments... sets a foundation for the government to prevent excessive spending on medical care. The public sector can set the prices for treatments and monitor if they're carried out properly." (Stand-up) "Among those who welcome the government's new policies is the field of Korean traditional medicine... where many treatments weren’t previously covered by the health insurance system. They say the new policies could raise demand for their treatments." The current insurance covers Korean traditional medical treatment by 35-percent in large hospitals and by 47-percent in small clinics. Expanded coverage will make treatment affordable for more patients... as seen through the government's trial program for traditional therapeutic massages, known as 'chuna'. Costs fell from the 26 to 80 dollar range to the 4 to 10 dollar range... and the clinic here has been seeing more patients. (Korean) "Korean medicine is very effective in curing scoliosis, disc diseases, arthritis and menstrual pains... but patients looked for other options because of the financial burden. So we've been voicing opinions that health insurance should expand coverage of our treatment." (Korean) "After a traffic accident, I first received treatment at Korean traditional clinics, but stopped later because of the high cost. But, thanks to the test program, I could receive treatment again at a lower price and I'm very happy about it." Korea's dental field also welcomed the move, saying a wider range of people can receive dentures and dental implants. But hospitals are concerned that lower medical bills could make it hard to manage hospitals and provide quality care. (Korean) "It's true that hospitals have been seeing losses in treatments that national insurance covers... and they've been making up for that loss through charging for treatments that national insurance doesn't cover. So, the government will continue communicating with the medical field and make sure to set appropriate prices for treatments." Also, the health care reform could result hurting small clinics. According to reports, Ted Cruz's plan is to change the legislation a little bit so that it basically creates two pools of people in the United States: the sick and the healthy. The healthy will have the option to buy into health insurance plans that don't cover very much, but they also don't cost very much. After all, these people are healthy, so they don't have as much to worry about, they can go on with their lives. Sick people, however, according to Ted Cruz's brilliant plan, they're all going to be lumped together. They're going to have to buy high deductible, high premium plans that cover more because, you know, they're sick people, people with preexisting conditions, like pregnancies. So, they're going to pay a ton more for health insurance, and everybody else gets to have their cheap stuff and walk away. That's Cruz's plan to fix the log jam that's taking place with the Republican healthcare plan. There's just one glaringly obvious problem with that, and this is something that healthcare market specialists are pointing out to Ted Cruz. Your plan would absolutely destroy healthcare markets around the country. You see, the way they explain it, the people who actually understand what they're talking about, if you only have two pools, one incredibly high risk and one low risk, the low risk people pay less money, that's fine. Insurance companies get less money from that. The high risk people have to pay even more money that they can't afford because Cruz still wants to strip them of Medicaid and all other forms of subsidies, so they drop out completely. Suddenly, you have health insurance companies that are not making enough money to survive because the high risk pool can't afford to pay premiums, and the people over here are paying nothing for premiums. Markets absolutely collapse. At that point, healthy people would then have to pay premiums for plans that cover less, or buy into the sick pool, which the premiums are going to be even higher over there. Essentially, according to the experts, there is no feasible way for Ted Cruz's plan to actually work if put into practice, but facts have never stood in the way of Ted Cruz. He is still pushing to get the legislation in the Senate changed to create these two separate insurance pools. Now, the reason we even have insurance pools to begin with is to share the risk. Healthy people and sick people get mixed in together so that everybody kind of pays an average. Yeah, it's slightly more for the healthier people, but it's slightly less for the sicker people. We all pay that difference to keep everybody healthy, and that's the point of healthcare for the United States. It's not just about one person or one small group of people; it's what works for everyone. The whole thing, basically, has to be a compromise or, as the experts say, it's going to fall apart and destroy the entire health insurance market for the United States. Is it worth it? Maybe. Maybe that's what Republicans want. Maybe they'll be happy if nobody can have health insurance. Then the whole issue just stops. People die because they can't go to the doctor, that's one less voter they have to pander to. But that's not how it should work in this country. We should care what happens to the sick. We should care what happens to the less fortunate. Nobody in this country should be written off just because they have some kind of preexisting condition or because they don't make as much as other people, and struggle to afford health insurance. That's not fair, and that's not what this country is all about. We take care of one another, or at least we should, because if not, according to the experts, the whole damn system comes crashing down. Ring of Fire needs your help! The new law requires that "California small group health insurance plans" must cover specific medical services or benefits. The way the rates, or prices, are calculated , changes dramatically. Starting 1/1/14, businesses need at least one eligible W2 employee to qualify for a group medical insurance plan. A sole proprietor or partnership without an employee must enroll in an individual health insurance plan. In California, you can't wait more than 60 days to enroll newly hired employees -- in all other states the "new hire waiting period" is 90 days. This means that when your group insurance plan renews in 2014 your waiting period will likely become the first of the month following one month of employment. The "Affordable Care Act" (ACA) also limits the number of plans an insurance company will offer. Blue Shield of California , for example, currently offers 40 plans. In 2014 they will offer only 16 plans -- and these include full and narrow network HMOs. Note that Blue Shield currently offers more PPO plan options than all of the plans they'll offer in 2014 under ObamaCare. Or, consider Kaiser Permanente, they currently offer 17 plans. In 2014 they will offer only 13 plans and number of their popular co-pay HMO plans with no deductible will drop from 5 to 2. This means that you'll likely have to pay a much more each month to the insurance company for a richer benefit plan -- whether you want it or not We know that some changes will likely increase small group rates. The "Risk Adjustment Factor" or RAF -- where rates can go up or down 10 percent based on the health condition of enrollees - goes away in 2014. So, groups with the lowest ,0.90 RAF will likely see higher rates. Beginning in 2014 the exact age of an employee will determine his/her premium. So a 31 year old will cost more than a 30 year old. Currently, employees in a certain age range, such as 30-39 get the same rate for the same plan. Also, the way rates are calculated for dependents will change. In 2014, each dependent will have a separate rate based on his or her age. Currently, there is one rate for a family, regardless of the ages of a spouse and children. These changes will likely increase the cost of health insurance for most people. So, what should you do to save money? The insurance companies have seen the 2014 health insurance plans and rates and they know that most people will pay more for their coverage. To delay the sticker shock, all insurance companies are allowing small groups to RENEW EARLY. "Early renewal" means that you can keep your current plan at the 4th quarter 2013 rates for a full 12 months. Many people are hoping that something will change between now and December 2014 that will reduce the rates...

Some may have questions about how elimination of the individual mandate penalty may impact their health coverage. I will try to address these questions in this video and help you understand how the elimination of the individual mandate penalty may affect you. What does this mean? - The only coverage-related change made by the new tax law is that the individual mandate tax penalty will no longer be in effect beginning in 2019. - The health insurance coverage, including financial assistance (subsidies/tax premiums), will NOT change in 2018. - The individual mandate penalty remains in effect for 2018 coverage; which means you will need to be insurance if you want to avoid paying a penalty in 2018. What does the elimination of the individual mandate tax penalty mean for consumers? • For 2018, individuals who can afford health insurance but choose not to enroll for coverage will be required to pay a penalty. What is the penalty for year 2018? The annual penalty is the greater of: - $695 for each adult and $347.50 for each child, up to $2,085 per family. -2.5 percent of the tax filer’s annual household income minus the federal tax filing threshold. • For individuals who do not buy insurance because it would be “unaffordable” for them, in 2018 they may not be required to pay a penalty if they file for an exemption from the penalty. Moscow doctors, citizens angry about health reforms

Authorities in the Russian capital Moscow have initiated a plan to reform the city’s healthcare system. But the reforms have led to the closure of dozens of medical institutions in the capital which has a population of over 13 million people. The reforms are also likely to cause a reduction in the number of hospital staff. And this has angered both the doctors and ordinary citizens. Ordinary Muscovites say the reforms have destroyed their health system. They accuse authorities of not caring about people and instead being interested in profit and money. Over the past 14 years, the number of medical institutions has fallen sharply. The reforms have also caused the closure of a number of maternity hospitals, clinics and the dismissal of employees from 28 medical institutions. Many people believe that the reform may provoke social unrest. They say health care reform is focused on budget cuts instead of improving the quality and availability of free medical care. Health expenditures are reduced by 22.9% for the 2015 federal budget, but the government says it is streamlining the country's health care system. In 2006, when Indiana small-business owner Scott Womack purchased a development agreement to expand his IHOP franchise into Ohio, he had no idea Congress would pass a massive overhaul of the health care system four years later. Today, one year after that legislative overhaul became law, Womack is very aware of Obamacare -- and of its effects on his plans for growth. Under the year-old law, Womack must provide health insurance to all full-time employees beginning in 2014. Right now, he employs nearly 1,000 full- and part-time workers and already offers insurance to his management staff. He simply does not know how he'll generate the revenue to do more. Womack estimates the cost of the law to his company will be 50 percent greater than his company's earnings -- in other words, beyond his ability to pay. That's not because his company of 12 IHOP restaurants in Indiana and Ohio is unprofitable. Quite the opposite, in fact. By industry standards, he's doing well. But labor-intensive restaurants generate profits of just 5 percent to 7 percent per employee. With fears about how he'll afford to provide health insurance with those low profit margins, Womack is worried about his expansion plans in Ohio. He can't exactly cancel his development agreement. But he'll only be able to fund his new restaurants -- and the construction, real estate and manufacturing jobs that would go along with them -- if Obamacare is repealed. "If the health care reform law is not repealed or if the employer mandate doesn't go away, we're going to have to take drastic action," Womack explains. From his perspective, the law represents Congress' fundamental misunderstanding of important differences among industries. He's frustrated that so few lawmakers sought input from people like him -- but he's doing what he can to speak up now to offer a glimpse into the law's effects on small-business owners.
