If someone asserts the defense of 'not guilty by reason of insanity,' California law follows the M'Naghten rule. Under the M'Naghten test, a person is legally insane if, at the time of the crime, he (1) didn't understand the nature of his act and (2) couldn't distinguish right from wrong. In this video, we discuss process for asserting the defense of not guilty by reason of insanity and application of the M'Naghten rule. We are a criminal defense law firm with significant experience defending clients suffering from mental illness. Trauma symptoms are often misdiagnosed. Some of these are depression, bipolar disorder, and schizophrenia. www.HelpFrorTrauma.com The Instinctual Trauma Response Model is an outcome and evidence-based model developed after 30 years of work in hospitals and clinics by Dr. Louis Tinnin and Dr. Linda Gantt. It is successful in dramatically reducing and most often eradicating Post Traumatic Stress Disorder, PTSD, and the many symptoms PTSD can have such as depression, bipolar depression, ADHD, ADD, fears, panic and anxiety. The ITR Model was conceived and used in hospitals dealing with mental disorders and trauma treatment clinics for over 30 years. The Instinctual Trauma Response Model was developed by the innovative psychiatrist Dr. Louis Tinnin, and his wife, Linda Gantt, PhD., an acclaimed art therapist. They both had a passion to help people suffering from the effects of adverse events in their lives, including preverbal trauma and the PTSD symptoms caused by them. An adult who experienced traumatic birth or an incident as a toddler can report life-long symptoms of anxiety with nervousness and spells of terror or panic. They may have temper outbursts and urges to smash or break things. They have depression, self-consciousness, distrust of others, and a high vulnerability to stress. Do I have trauma? Did you ever experience abuse in any form such as: Sexual abuse Verbal Abuse Emotional Abuse Religious Abuse Domestic Abuse Sibling Abuse Neglect as a child Bullying Were you adopted? Did your parents go through a divorce when you were a child? Have you survived a natural disaster or a car accident? Did you have surgery or a medical procedure as a child or adolescent? Does fear hold you back when you try to do something new? Do you feel like the other shoe is going to drop just when things are going well? Do you have a hard time being in a stable relationship? Mental Heath Videos with Kati Morton Dissociation is a term in psychology describing a wide array of experiences from mild detachment from immediate surroundings to more severe detachment from physical and emotional experience. It is commonly displayed on a continuum. The major characteristic of all dissociative phenomena involves a detachment from reality -- rather than a loss of reality as in psychosis. In mild cases, dissociation can be regarded as a coping mechanism or defense mechanisms in seeking to master, minimize or tolerate stress -- including boredom or conflict. At the nonpathological end of the continuum, dissociation describes common events such as daydreaming while driving a vehicle. Further along the continuum are non-pathological altered states of consciousness. More pathological dissociation involves dissociative disorders, including dissociative fugue and depersonalization disorder with or without alterations in personal identity or sense of self. These alterations can include: a sense that self or the world is unreal (depersonalization and derealization); a loss of memory (amnesia); forgetting identity or assuming a new self (fugue); and fragmentation of identity or self into separate streams of consciousness (dissociative identity disorder, formerly termed multiple personality disorder) and complex post-traumatic stress disorder. Dissociative disorders are sometimes triggered by trauma, but may be preceded only by stress, psychoactive substances, or no identifiable trigger at all. The ICD-10 classifies conversion disorder as a dissociative disorder. The Diagnostic and Statistical Manual of Mental Disorders groups all dissociative disorders into a single category. Although some dissociative disruptions involve amnesia, other dissociative events do not. Dissociative disorders are typically experienced as startling, autonomous intrusions into the person's usual ways of responding or functioning. Due to their unexpected and largely inexplicable nature, they tend to be quite unsettling. The story of Ricky, a convicted child molester and murderer, and the mother of the child he killed; and of mental illness, the death penalty, victimhood and seeking understanding. Clive Stafford Smith OBE is a lawyer specialising in defending people accused of the most serious crimes, and is Founder and Director of the UK legal action charity Reprieve. Clive spent 26 years working as an attorney in the Southern United States, where he represented over 300 prisoners facing the death penalty. Whilst only taking the cases of those who could not afford lawyers, he prevented in the death penalty in all but six cases (a 98% “victory” rate). Few lawyers ever take a case to the US Supreme Court. Clive has taken five, and all of the prisoners prevailed. -- TEDxExeter 2015 took the long view both back into the past and ahead into the future. So to give you a breakdown, if you’re a patient of this site, you sign up, and you fill out a basic form explaining what you’re looking for, and what may you may be experiencing, and what they do is that they have an extensive roster of therapists who are allegedly qualified, we’ll return to the allegedly part in a bit, anyway, they hook you up with one of these therapists. The ultimate aim? Well that’s unclear, and we’ll explain why that’s a problem in a bit, but the general aim is to improve health. But if you’ve seen the title, you’ll know that this is a video about YouTubers, so where do they factor into this very enticing plot? Well BetterHelp targeted a certain band of YouTubers, in fact, ones that I like to talk about the most. The individuals who are seen as moral bastions on the platform, this is no coincidence, these individuals have built special relationships with their fans, and unlike the Jake Pauls of this generation, they deal with mature subjects, they have a slightly more adult audience, this is the sort of thing that is perfect. And honestly the environment has been set up pretty neatly for something like this to come into play. Now, make no mistake, BetterHelp has existed for a few years, since its inception in 2013, it was always purring in the background, but recently, one of their marketing executive must have spotted an opportunity in the fertile grounds of YouTube. Which is a smart idea in principle. In the last few years, YouTube has become a lot deeper than just a place where people put on facades for the day, and I’ve spoken about that in length in the past. It just seems like a progression of the culture. Amongst a lot of the deeper topics that have popped up in the last few years, one that seems increasingly prevalent is that of “depression” and mental health, there are a multiple reasons for this. I think the online world has brought together a new set of people who find themselves away from the turmoil of their real lives, and in that escape we equally tried to find answers for the problems that we face in our minds, and one of those does come down to mental health. Depression as such is a complex topic, we need to be able to distinguish between when we may just be experiencing mood dips, and when we actually have a chemical imbalance that disposes us to be legitimately depressed. A great example of the confusion of the two was Prince EA’s video on how you’re not depressed, you just have to shut up. Also, was great to see that Prince EA made the Mental Health Awareness day, after such an inspirational set of videos. YouTubers know that speaking about depression is extremely sensitive, you can’t be seen as taking advantage of the topic, but equally we are in a culture where people are being encouraged to be open about their experiences with the condition, and often being open about these things can help others, and we certainly shouldn’t diminish that. On the other hand, we shouldn’t be seen as clickbaiting it, or taking advantage of the possible experiences of suffering to emotionally manipulate our audiences, so ironically it becomes a whole different balancing act on working out how to appear genuine, which in a way, is contrived within itself. But that’s a topic for a different time. Equally, creators who use these experiences in their videos will create a bond with the audience, often creating a shared experience, and maybe helping an individual come to terms with their own struggles, and so it made perfect sense that BetterHelp reach out to these lovely creators, who are renowned for their reputability, to promote their therapy website and help others make it through the same struggles but there’s a catch, in fact there are a lot of catches. I discuss the recent case of People v. Wood. There is a clear and distinct difference between insanity defense and GBMI finding. This case features the defendant who has to be in the lead for this year's “Least Helpful to His Defense” award. First of all, the insanity defense is a complete affirmative defense. Like all other affirmative defenses it acts as a complete acquittal if it can be won. The defense (or prosecution) has to present some evidence of insanity. The Illinois Compiled Statutes Criminal Code states that: “A person is insane and not criminally responsible for his conduct if he lacks substantial capacity to appreciate the criminality of that conduct due to a mental disease or defect.” 720 ILCS 5/6-2(a). The guilty but mentally ill (GBMI) finding, on the other hand is no defense at all. A defendant found guilty but mentally ill is going to prison. That is why they use the word “guilty.” What a person achieves by “winning” the GBMI finding is assured mental treatment while in prison. Maybe, not much but you take what you can get. This may be very valuable and beneficial to a guilty person and society. The Criminal Code says that: "... mental illness is not an affirmative defense, but an alternative plea or finding that may be accepted, under appropriate evidence, when the affirmative defense of insanity is raised or the plea of guilty but mentally ill is made.” 720 ILCS 5/6-4. The law provides only two avenues to a finding of GBMI. (1) A defendant can plead it. If for some reason a defendant chooses to not plead guilty, and (2) proceeds to trial, a court may make a finding of GBMI if the insanity defense is lost. This, of course, presumes that a defendant initially raises the insanity defense at trial. If the insanity defense is not raised at trial, by pleading, then a defendant may not be awarded the GBMI finding even though there is evidence presented of mental illness. This was the problem described in this case.

A person is held not responsible for his criminal actions if s/he cannot tell right from wrong ("lacks substantial capacity either to appreciate the criminality (wrongfulness) of his conduct" - diminished capacity), did not intend to act the way he did (absent "mens rea") and/or could not control his behavior ("irresistible impulse"). These handicaps are often associated with "mental disease or defect" or "mental retardation". Mental health professionals prefer to talk about an impairment of a "person's perception or understanding of reality". They hold a "guilty but mentally ill" verdict to be contradiction in terms. All "mentally-ill" people operate within a (usually coherent) worldview, with consistent internal logic, and rules of right and wrong (ethics). Yet, these rarely conform to the way most people perceive the world. The mentally-ill, therefore, cannot be guilty because s/he has a tenuous grasp on reality. Yet, experience teaches us that a criminal maybe mentally ill even as s/he maintains a perfect reality test and thus is held criminally responsible (Jeffrey Dahmer comes to mind). The "perception and understanding of reality", in other words, can and does co-exist even with the severest forms of mental illness. This makes it even more difficult to comprehend what is meant by "mental disease". If some mentally ill maintain a grasp on reality, know right from wrong, can anticipate the outcomes of their actions, are not subject to irresistible impulses (the official position of the American Psychiatric Association) - in what way do they differ from us, "normal" folks? However, there is a line of cases in which the prosecution's burden of proof has been defeated by proof of mental illness. The judge does have discretion to allow proof of mental illness to be introduced into a case. What is INSANITY DEFENSE? What does INSANITY DEFENSE mean? INSANITY DEFENSE meaning & explanation. The insanity defense, also known as the mental disorder defense, is a defense by excuse in criminal trials arguing that the defendant is not responsible for their actions due to an episodic or persistent psychiatric illness. Exemption from full criminal punishment on such grounds dates back to at least the Code of Hammurabi. Legal definitions of insanity or mental disorder are varied, and include the M'Naghten Rules, the Durham rule, the American Legal Institute definition, and other provisions, often relating to a lack of mens rea ("guilty mind"). In the criminal laws of Australia and Canada, statutory legislation enshrines the M'Naghten Rules, with the terms defence of mental disorder, defence of mental illness or not criminally responsible by reason of mental disorder employed. In the United Kingdom, Ireland, and the United States, use of the defense is rare; however, since the Criminal Procedure (Insanity and Unfitness to Plead) Act 1991, insanity pleas have steadily increased in the UK. Mitigating factors, including things not eligible for the insanity defense such as intoxication (or, more frequently, diminished capacity), may lead to reduced charges or reduced sentences. The defense is based on evaluations by forensic mental health professionals with the appropriate test according to the jurisdiction. Their testimony guides the jury, but they are not allowed to testify to the accused's criminal responsibility, as this is a matter for the jury to decide. Similarly, mental health practitioners are restrained from making a judgment on the issue of whether the defendant is or is not insane or what is known as the "ultimate issue". Some jurisdictions require the evaluation to address the defendant's ability to control their behavior at the time of the offense (the volitional limb). A defendant claiming the defense is pleading "not guilty by reason of insanity" (NGRI) or "guilty but insane or mentally ill" in some jurisdictions which, if successful, may result in the defendant being committed to a psychiatric facility for an indeterminate period.

Prosecutor Juan Martinez's first rebuttal witness, psychologist Janeen DeMarte, describes Jodi Arias as strange, immature and having borderline personality disorder. As part of her diagnosis, DeMarte discusses Jodi's unstable and intense interpersonal relationships, identity disturbance, suicidal behavior and ideation, affective instability, feelings of emptiness, and probably most significant to the case, "inappropriate intense anger." This "inappropriate intense anger" is a side to Jodi that hadn't really been discussed in court up to this point. DeMarte reads an email Jodi sent to Travis where she reveals that her "anger is very destructive", that she's kicked holes in walls, kicked down doors, smashed windows, and broken things. Jodi writes that this anger "hurts people and it hurts me." Was Jodi feeling this anger on a colossal scale when she finally came to the realization that Travis did not want to be with her? On another note, some of this testimony may arguably be helpful to the defense for mitigating factors against the death penalty. Some of the testimony may humanize her. DeMarte testified that she does believe Jodi had suicidal thoughts spanning from 1995 and had feelings of emptiness. Science-based new understanding of mental illness emphasizing continuums, regulation, and psychological defence. Accurately defining mental illness is crucial for treatment providers and researchers, because it fosters a comprehensive understanding and optimizes therapeutic interventions. In addition, it frees psychopathology from political and financial influences that weaken its scientific integrity. In combination, continuums, regulation, and defense, robustly define mental illness. Continuums: Psychopathology embodied by major diagnostic systems (DSM and ICD) emphasizes discrete conditions, in line with our psychological preference for discreteness. However, nature almost universally gravitates to continuums. Naturally occurring mental illness continuums are identified, based on neuroscience and other relevant data. Regulation: Despite how biological systems rely on regulation, it is largely neglected when it comes to mental illness. Psychopathology frequently arises from impaired regulation, fostering a shift from milder expressions on continuums to extreme manifestations. A diverse collection of therapeutic techniques, under the umbrella of cognitive regulatory control therapies, is presented that restore effective regulation. Defense: The surprising role of psychological defense, understood in terms of compensation for stressors, is described for the various mental illness continuums, and techniques are provided to augment healthy defensive functioning. The model of psychopathology proposed aligns with its natural organization, thereby placing mental illness on a more scientific foundation.
