I have had very good results representing clients in Social Security disability hearings who are dealing with the pain and discomfort of #inflammatoryarthritis. Unlike #osteoarthritis, which is much more common, inflammatory arthritis includes diagnoses such as #rheumatoidarthritis, #psoriaticarthritis, #septicarthritis and even #lupus. Here is a WebMD article that discusses the various forms of this condition - http://bit.ly/1pByhzG. #Inflammatory conditions usually involve distinctive symptoms such as redness, swelling and identifiable damage to the affected joints. As I discuss in this video, if you are pursuing #SSDI or SSI benefits based on one of these conditions, make sure to differentiate your condition from the much more common osteoarthritic condition. When treating, advise your doctor of all symptoms as your words will become part of your medical record. Also, whenever possible you should seek treatment from a specialist such as a rheumatologist, as opposed to a family doctor. Not only will you have more and better treatment options but your medical record will resonate better with a disability judge. I also advise my clients to make on-going notes about the side effects of their medications. After a while your fatigue, mental confusion and loss of physical dexterity may become part of your day to day existence, but for a Social Security judge, these limitations on your activities of daily living are very relevant to the question of whether you can perform basic work activities. Finally, do not hesitate to make notes to take with you to your hearing. Spinal Stenosis: Strong Evidence of Disability

If your medical records indicate that you have spinal stenosis in your spine, and you have symptoms such as pain, numbness, pins & needles sensation, and weakness, you most likely have a strong claim for Social Security disability. As I discuss in this video, spinal stenosis means that there is an abnormal narrowing of your spinal canal. This can be caused by arthritis, bone spurs, injuries or just aging. Stenosis can also occur in the cervical (neck) spine, thoracic (mid-back) spine, or lumbar (low back) spine. Often, surgery may be recommended, but, remember that Social Security cannot deny benefits to you if you choose not to undergo surgery, even if that surgery would likely correct the problem. This is because every back or neck surgery carries with it the risk of death or paralysis. Social Security disability claimants seeking SSDI or SSI benefits based on a long term HIV infection can be approved if they present evidence of complications that will preclude competitive work. SSA's treatment of HIV claims has changed significantly over the past 15 years. In the 1990s and early 2000's, most judges felt that HIV was a precursor to AIDS and generally treated HIV infections and AIDS as one in the same. About 10 years ago, judge took notice of advances in medical science that allowed people infected with HIV to suppress the virus and lead apparently normal lives. HIV was then treated similar to Hepatitis - an active, uncurable condition but one that need not prevent a claimant from working for years at a time. Over the last 4 to 5 years, however, Social Security judges have become more open to the idea that HIV often does create complications that, when considered as a whole, can prevent an afflicted person from working. Mayo Clinic uses stem cell therapy to treat arthritis in knee

Researchers at Mayo Clinic’s campus in Florida have conducted the world’s first prospective, blinded and placebo-controlled clinical study to test the benefit of using bone marrow stem cells to reduce arthritic pain and disability in knees. It is the first time that the belief that stem cells can provide substantial and possible regenerative relief in an ailing joint has been put to the test in such a rigorous fashion. The researchers say such testing is needed because there are at least 600 stem cell clinics in the U.S. offering one form of stem cell therapy or another to an estimated 100,000-plus patients, who pay thousands of dollars, out of pocket, for the treatment, which has not undergone demanding clinical study. The findings in The American Journal of Sports Medicine represent another first —patients not only had a dramatic improvement in the knee that received stem cells, but also in their other knee, which also had painful arthritis but received only a saline control injection. Each of the 25 patients enrolled in the study had two bad knees, but did not know which knee received the stem cells. Given that the stem cell-treated knee was no better than the control-treated knee — both were dramatically better than before the study began — the researchers say the stem cells’ effectiveness remains somewhat uninterpretable. They are only able to conclude the procedure is safe to undergo as an option for knee pain, but they cannot yet recommend it for routine arthritis care. “Our findings can be interrupted in ways that we now need to test — one of which is that bone marrow stem cell injection in one ailing knee can relieve pain in both affected knees in a systemic or whole-body fashion,” says the study’s lead author, Shane Shapiro, M.D., a Mayo Clinic orthopedic physician.

Rheumatoid arthritis affects 1 in 100 Australians. It is a major cause of disability and psychological distress due to its chronic, painful and disabling character. Rheumatoid arthritis, an inflammatory autoimmune disease, is the second most common type of arthritis after osteoarthritis. The disease is more common amongst women and in the older age groups. Untreated rheumatoid arthritis can result in joint damage and deformities. The disease impacts on activities of daily living, capacity to work, and family life. Early diagnosis and medical intervention are critical to limiting structural damage and improving health outcomes. The Clinical Guideline for Diagnosis and Management of Early Rheumatoid Arthritis presents recommendations to assist and support clinical judgement of GPs in managing patients with rheumatoid arthritis. This program, in line with the Guideline, focuses on diagnosis, early management, and coordination of multidisciplinary care needs for people with rheumatoid arthritis. Pharmacological and non-pharmacological interventions are reviewed. The Clinical Guideline recognises the need for every patient with rheumatoid arthritis to have a thorough assessment of their individual needs; access to a range of health professionals; and a comprehensive care plan. This program is one of four in the Musculoskeletal Guideline Series. The Royal Australian College of General Practitioners (RACGP) has developed national musculoskeletal clinical guidelines for general practitioners and other primary care health professionals for osteoarthritis, rheumatoid arthritis, juvenile idiopathic arthritis and osteoporosis. SSA's "Listings of Impairments:" Fast Approval for Your Claim

Social Security recognizes that some medical conditions are so serious and debilitating that you qualify for disability (i.e., you cannot work any more) automatically. These serious medical conditions are set out in the SSA Blue Book as the Listings of Impairments. The Blue Book contains 14 sections - each describing a body system - including such things as the musculoskeletal system (Listing 1), the cardiovascular system (Listing 4), neurological disorders (Listing 11), etc. In this video I explain how I use the Listings to identify cases that might be appropriate for an early approval. Not every case meets a listing, but I see plenty of listing level cases that fall through the cracks because the claimant does not know how to give SSA what it needs to issue an approval. Many deserving cases are not listing level, so don’t get discouraged if you don’t see an applicable listing for your medical problem. Dr. Ebraheim’s educational animated video describing the condition of Psoratic Arthritis - Psoriasis. Psoriatic arthritis is a very important topic for any orthopaedic exam. Seronegative spondyloarthropathies accept approximately 10% of patients with psoriasis. If the spine is affected, the Human Leukocyte Antigen B27 (HLA-B27) is positive more than 50% of the time. The clinical presentation of psoriasis in the cervical spine could be similar to rheumatoid arthritis, but in general it is different than ankylosing spondylitis (debatable and controversial). Psoriatic arthritis will have negative rheumatoid factor and negative antinuclear antibody (ANA) tests. Psoriatic arthritis presents itself with patchy, plaques, and scales that can be red or silvery in color. It usually occurs before the arthritis and usually occurs at the elbow or the knees. It usually occurs at the extensor surface of the extremity. Always check the elbows! In about 20% of cases, the arthritis usually occurs before the scales and the plaques. This makes you wonder; why is the knee not getting better? Why is the swelling not going away? Psoriatic arthritis most commonly affects the hands, the feet, the spine and the sacroiliac (SI) joints. Hand: this is very important information for clinical practice and also for the exams. •Dactylitis: sausage digits •Pencil-in-a-cup deformity: the DIP is involved. Some believe this is an x-linked recessive trait. •Nail pitting: fragmentation and discoloration •Onycholysis: lifting of the nail plate that starts distally. •Arthritis mutilans You may get: •Uveitis •Achilles tendonitis •Plantar fasciitis •Conditions similar to Reiter’s syndrome (reactive arthritis) Treatment: •Usually medical treatment oNonsteroidal oMethotrexate oTNF-alpha inhibitors •Surgery (occasionally) oThere is a high infection with surgery oTry to avoid skin incisions through the active psoriatic lesions (there is a high colonization with bacteria. oDo preoperative treatment of such lesions. Here's how to find out and claim your benefits. Step 1: Investigate and inquire Talk to friends and research online to find out about disability benefits. If you are no longer able to function for your employer or expect to be out of work for at least a year due to a disability, you may be eligible. Tip Though an attorney is not necessary, your chances of being approved are better if you have one. Step 2: Obtain an application Obtain an application from the local Social Security Administration office. You can get the form online if you're over 18 years old. Then submit the form and make an appointment. Step 3: Get interviewed Interview with a representative who will ask your permission to speak with a doctor about issues regarding your disability. The information will be used to complete the disability report. Step 4: Answer questions Answer questions about the work you performed before the date of your disability. Provide background information regarding your family, military service, treatment, depression, pain, and previous worker's compensation incidents. Step 5: Expect close scrutiny Expect Social Security representatives to examine whether the years you worked qualify your claim and whether your condition merits benefits. The Disability Determination Services office will also evaluate your current work activities and abilities. Tip You may qualify for Supplemental Security Income, or SSI, if you are elderly, blind, or disabled, and can demonstrate financial need. Step 6: Pass review Pass the board's review of suitability to be submitted for approval. If they're not able to make a clear recommendation, the board may order a special state medical examination before making a final determination. Step 7: Wait for approval Wait for the claim to be reviewed by a state agent who will determine your eligibility for benefits, which generally takes less than four months. Did You Know? Some type of back disability effects most people at one time or another, inhibiting their ability to work. While the bulk of back injuries are short term and workers are able to resume their employment, for some people a disability back problem can turn into a life time of pain that effects their quality of life. Back disability claims are routinely challenged by disability insurance companies, The Social Security Administration and The Department of Veterans Affairs. If this has been your experience it may be time to seek legal help, in order to prove you are indeed disabled. If your disability claim is based on a group employee benefits plan or private disability insurance plan the insurance company will do their best to deny your claim based on insufficient medical records and many other arguments. Employee benefits and Private Disability Insurance are governed by very different laws. Determining whether your claim is governed under federal ERISA law is extremely important. The ultimate issue will be whether you can still preform your own occupation, or in some cases whether you can preform any occupation that will pay a certain percentage of your former salary. The Social Security evaluation is different, in that it doesn't focus on a persons diagnosis. Social Security Disability is based on the functional limitations the claimant has. Your back disability must be judged sever enough to prevent you from preforming substantially gainful activity for 12 months or more. The Social Security Administration explains their complex disability determination process in their publication known as The Listings of Impairments. Most back cases are evaluated under section 1.04 of The Listings. Veterans suffering from service connected Back injuries are often denied VA Disability Benefits. If the Veterans Claim is approved it's common for them to be assigned an unsatisfactory disability rating. Neck and Back injury cases are some of the most demanding and disputed VA Disability Cases. The VA offers Veterans an exhaustive guide that describes how back disability and other impairments of the muscular skeletal system are determined and rated. You can find it in the VA publication known as The Schedule for Rating Disabilities. What Type of Back Conditions might qualify for Disability Benefits? While a back disability may refer generally to an injury or disorder of the back and spine area, spinal injuries are back disorders that entail specific damage to the spinal itself, including Nerve Damage to the Spinal Cord. Is it possible to lose your Social Security disability case within 5 minutes of meeting your judge? Unfortunately, the judge assigned to your case is likely overworked, tired and frustrated. He or she is under pressure from regional and national judicial offers to only approve deserving cases. So, when you testify, the last thing you want to do is ask the judge to believe something that is out of line with the patterns he sees. For example, if you are alleging disability based on severe back pain, the judge will expect you to testify that you spend your days in a recliner with your legs extended, that you can't stand up long enough to cook a meal, and that you can only get by with the help of potent prescription painkillers that leave you sleepy and severely constipated. If you testify that you self medicate with marijuana or that you borrow pain pills from your buddy or that you sometimes ride along with your son when he drives to work, the judge is not going to find your believable. How Can You Win SSD Benefits for Spinal Disorders? Try Using SSA Listing 1.04

Board Certified Disability Attorney, Marc Whitehead explains how you can win your SSD Benefits for Spinal Disorders using the SSA Listing 1.04. Anyone apply for disability benefits from the Social Security Administration (SSA) has two possible ways to prove that they qualify. 1- They can meet the requirements defined for individual conditions in the SSA's Listing of Impairments. 2- They can prove that they are unable to work due to their impairment by using the SSA's 5 step sequential evaluation process. Of the two options meeting one of the listings is by far the preferred method because it is much more straight forward. What are the Listing of Impairments? These are a list of medical criteria or standards that the SSA has come up with the define a particular condition. Anyone who proves they meet anyone of these definitions qualifies for Disability Benefits automatically. All you have to do is show that your condition matches the criteria and that you have been without a job because of it for at least 12 months. Naturally, it's not quite that simple though. In order for you to prove to the SSA that you meet their criteria you need very specific, subjective documentation. To meet listing 1.04, Disorders of the Spine, there are several things you can show to the SSA: 1- You can show evidence of nerve root compression. Those suffering from this show motor loss, limited spinal motion, neural anatomical pain distribution, sensory loss or a loss of reflexes. If the lower back is involved these people typically will have a positive straight leg raising test. 2- They can show evidence of Spinal arachnoiditis. People with this condition experience severe, painful burning that forces them to move around and change positions frequently, usually more then once every 2 hours. Or 3- They can show proof of lumbar spinal stenosis resulting in pseudoclaudication. Suffers experience chronic nonradicular weakness and pain that prevents them from ambulating effectively. In order to prove any of these issues you'll objective medical evidence gained from testing. There are many tests the SSA uses to identify spinal disorders including: - X-Rays of the cervical Spine and Lumbar Spine - Range of Motion Testing - Straight Leg Raising Testing - CT Scans of the Spine - MRI's - Megadeth Neuropathy Evaluations - Functional Residual Capacity Exams - Nerve Conduction Studies Testing positive on one or more of these tests can help provide you with the evidence you'll need to prove to the SSA that you meet the requirements of the Disability Listing and automatically qualifies you for benefits. Failing to match all of the requirements in the Listing of Impairments doesn't have to be the end. Remember that many can, and do go on to receive benefits by using the 5 Step Sequential Evaluation Process. If you can prove that your condition prevents you from working at any job in the country that your experience or education would otherwise qualify you for the SSA will approve your claim. Tucker explains how to tell if a long term disability buyout settlement is a good choice for your situation. A buyout settlement is a lump-sum payout. You will only get one payment, instead of monthly payments. You're not going to get what you're owed, pennies to the dollar. That's not what a settlement is. They want to save money, so they will offer you a lower amount up front. You also need to understand the concepts of “present value” and “time value of money”. Instead of giving you the full value of your claim that would be the sum of future payments, they are offering you a smaller amount that you could choose to invest. The theory is that this money would earn interest and grow to the value of your claim over several years. The insurance company will calculate these values. You'll also want to do these calculations your own. If the company makes an offer, you'll want to determine several important values and consider the risks. You need to know the percentage of the present value that is being offered. Online calculator tools exist for determining present value. Second, you'll want to remember that you risk eventually having your benefits cut off if the insurance company feels that you are no longer disabled. Can you deal with that possibility if it comes to pass? There are several other questions you need to consider when making this decision. Do you want to deal with the insurance company calling you to check in for years to come? Do you have a plan for the money if you take a lump sum, such as buying a home? An attorney can help you to address these concerns, but you will ultimately need to make these choices for yourself, based on your personal situation. Prepare for Trick Questions from the Social Security Judge

Testifying at your Social Security disability hearing is not the same as having a conversation with your neighbor or even talking to your doctor. When your judge asks you questions about your medical condition, he will be listening for two purposes: (1) he wants to a better understanding of how your medical issues impact your day to day life; and (2) he will use your testimony to make a decision about your credibility. Social Security judges understand that your written medical record does not tell the whole story about your capacity to function in a job. After all, most doctors are primarily focused on treating you, not evaluating your work capacity. Further, some doctors minimize symptoms in their notes to paint a picture of successful treatment, or because they do not believe in the concept of disability. Whatever his conclusions about medical records, the judge wants to hear from you. But he is not going to accept your testimony as truthful if he believes that you are prone to exaggeration or that you are more focused on collecting benefits than fighting to return to work. Often you can expect your judge to ask you questions to which he already knows the answer. In this video, I describe a recent hearing where the judge asked my client about his cigarette smoking habit. The judge asked these questions for the express purpose of evaluating my client's credibility, and by answering inaccurately, my client definitely damaged his case. Depression is not a sign of personal weakness, it is a real mental illness with real causes. To determine a persons eligibility for benefits the SSA adheres to their Listings of Impairments. The Listing for depression is found under Mental Disorders. If your condition is sever enough to satisfy these requirements, you'll be considered disabled by the SSA. The SSA will need medical evidence to support your exact limitations. This means that they will wanna see medical records and psychiatric records from doctors psychiatrists, physiologists, mental health clinics or other health facilities where you received treatment. VA & Depression: Depression disordered are often endured by Veterans would have lived through the emotional stress of War, the death or injury of fellow soldiers and comrades, living through unbearable conditions or struggling with their own physical injuries or disorders. Veterans Disability benefits are based on the establishment of a service connected impairment. Disability ratings are assigned based on the severity of the impairment or combination of impairments. VA disability payments are then awarded based on this assessment. Depressive disorders may begin because of experiences or injuries the Veteran had while in service. Traumatic brain injury is frequently responsible for the onset of depression. Depressive illness may be closely related to other service connected disorders, such as PTSD. LTD & Depression: You may also be able to clam disability benefits through your LTD insurance for your depression. Whether you have LTD insurance privately or through your employer, it's the insurance carrier who will process the claim. It has become routine practice for many insurance companies to deny legitimate claims for depression or to devalue these claims. Insurance claims for depression disability present their own unique set of challenges- like insurers stating that the disability is not sever enough to qualify for disability. Symptoms of depression are emotional and abstract, sometimes with highs and lows which makes it difficult to measure its severity. This then allows for insurers to claim you do not meet their definition of disability. Most insurance companies have a clause that states mental disorders as mental nervous for which the benefit pay period is limited to only two years. In their attempt to reduce payment periods your insurer may try to award benefits only for depression under the mental nervous condition clause with no separate recognition of the physical disability. As I discuss in this video, the answer is “no,” Social Security cannot punish you for choosing to forego any type of invasive surgery - whether an operation for a #herniateddisc on your lower back (#lumbarspine), your neck (#cervicalspine) or anywhere else on your back. Every type of significant surgery carries a certain amount of risk of complications, which could include #paralysis or even death. You also may not be an ideal candidate for #surgery - perhaps you live alone without anyone to help you after an operation, or perhaps you are a high risk surgical candidate because of #obesity, #diabetes or even because of emotional instability. Your back pain case will be stronger if your #orthopedicsurgeon or #neurosurgeon has recommended surgery - this shows that your condition is extremely serious. Top 5 ways to get Approved for Social Security Benefits

Andrew Kinney, a Social Security attorney with Hoglund, Chwialkowski & Mrozik, PLLC in Minnesota, explains the top five ways to get approved for Social Security benefits. In a typical year, Mr. Kinney does between four and five hundred hearings. In those hearings, he sees patterns of ways people get approved and patterns of ways that people get denied. His firm’s website is available at: http://hoglundlaw.com/ Here are the five top ways to get approved for Social Security benefits. One: Get an attorney. If you have an attorney, the attorney is trained in law, and the attorney can argue before the hearing in legal arguments and briefs, during the hearing with the judge who’s also an attorney, and also after the hearing, in terms of legal arguments. During the hearing as well, there are experts that your attorney can cross-examine. So if you want an attorney, you need to make sure to hire a law firm because only lawyers and law firms can give legal advice. Two: Make sure to treat for your medical conditions. If you have a medical problem but don’t get care for it, it’s hard to prove at a hearing with the medical records we have, what’s wrong. Especially if you decide perhaps there’s nothing that can be done. So if you have a medical problem for which perhaps no surgery is possible right now, be sure to still treat from time to time for it. Make sure your doctor knows how it’s progressing, because we need to prove what’s wrong, and to prove what’s wrong leads us to prove why you can’t work full-time for a medical reason. That’s the legal standard of disability. Three: Always take your medications. When someone is prescribed medications, such as a diabetic, it seems clear enough why someone needs to take the insulin. But there are also other medications for other conditions, such as depression, where medications can have some positive effect or maybe not as well have a positive effect. What is important is that if your doctor prescribed you medications is that you take your medications and if there’s a side effect make sure to talk with your doctor about it. Because one thing Social Security looks at is they determine whether you’re doing your best to get better. Four: Treat chemical dependency. If you have difficulty with alcohol or illegal drugs or prescribed pain medications for example, try to get help for that early on. Certainly it’s not healthy for you to have those difficulties, and in the clients that I help, that arises from time to time. For example, if someone has chronic depression or anxiety, and they also take illegal drugs, one of the problems over time is that the judges look at the treatment and decide, and legitimately so, that the medications you’re taking don’t work because they’re offset by your drug addiction. So if you have a medical problem such as a drug addiction, talk to your doctor about it, be up front about it and try to attack it because that can cloud the judge’s ability to see underneath that problem as to what you’re actually disabled for. Five: Try to get a statement from your treating doctor. And when I say statement it isn’t very effective if your treating doctor writes a letter and says, “I know Joe and he’s disabled.” What I’m talking about is something along the lines of what we do at Hoglund Law Offices. We have forms that lay out functional limitations that people have. And we ask a doctor, “What are the treating problems? How many days might they miss a month? What sort of hourlies, hourly work can they do where they work eight hours a day? Can they sit, stoop, walk, stand? From a mood point of view, can they concentrate, can they handle stress?” Things like that. We’re taking the doctor’s diagnoses and treatment, and justification for the diagnoses and treatment, and we’re taking it one step further. We’re having your treating doctor essentially come into the hearing room by form of this paper and testify what you are limited in doing. That does not guarantee an approval, but it definitely helps, for my clients, be able to get approved. So those are the top five ways to try to get approved for Social Security benefits. Chronic low back pain can support your winning claim for Social Security disability. You can greatly improve your chances of winning if you can show that your low back pain is severe and that you cannot function reliably in a work setting despite your desire to work. Because discomfort of the spine is a common ailment, your claims file must show something more than mild discomfort. In my Atlanta disability practice I find that Social Security administrative law judges expect to see: 1. a long, consistent work history - this enhances your credibility 2. consistent treatment with one or more doctors and compliance with that treatment 3. objective evidence of a spinal problems - preferably an MRI or CT scan that shows disc involvement 4. testimony from you describing as specifically as you can your activity limitations 5. support from your treating doctor(s) in the form of either a narrative report or a functional capacity form. Your Reconsideration Appeal: a Waste of Time or Can You Really Win?

Can you convince Social Security to approve your claim when you file your reconsideration appeal, or is reconsideration just a waste of time that will add 6 months of delay to your disability case? As I discuss in this video, only about 10% of reconsideration appeals end up with an approval but you can improve your odds by -using the right forms -submitting them electronically or by registered mail -including information in your recon paperwork that addresses the main issue in your SSD case - your capacity to work I have spent a lot of time reviewing SSA’s disability forms and I even wrote a book about the forms (see www.disabilityforms.com). What Should You do if You Get a Partially Favorable Decision?

What are your options if you get a partially favorable decision - either from the state agency adjudicator or from the judge? As I discuss in this video, a partially favorable decision means that Social Security wants to change the onset date of your disability. Perhaps you claim that your disability began 3 years ago; now Social Security says that they will approve you but using an onset date of 6 months ago. If you accept the amended onset date at initial or reconsideration, you will lost thousands or tens of thousands of dollars of lump sum, past due benefits. If you appeal the partially favorable decision at initial or recon and proceed to a hearing, you could end up with an unfavorable decision from the judge, as the judge is not bound to anything decided at the administrative level. At the hearing stage, your judge may offer to approve your claim with an amended onset date based on either the evidence or so that he/she can fit you into a grid rule. You should always discuss the implications of an amended onset date with your lawyer before accepting this change.
