Learn how long the continuing coverage lasts—and what it might cost you. WHAT IS COBRA? The Consolidated Omnibus Budget Reconciliation Act is a federal law passed in 1986. It requires companies with 20 or more employees to continue offering health insurance at group rates to former employees and their family members after they're no longer eligible for the group -- because of job loss or divorce, for example. Some states have similar rules for companies with fewer than 20 employees. WHO QUALIFIES? Former employees, spouses, former spouses and dependent children are eligible, regardless of their health. There are exceptions: You cannot get COBRA if your employer no longer offers health insurance to current employees. You're also out of luck if the company goes out of business. Federal employees are covered by a law similar to COBRA. HOW LONG DOES IT LAST? COBRA provides up to 18 months of coverage from the time you leave your job or drop to part-time status. The coverage lasts up to 36 months after you no longer qualify as a dependent on an employee's policy. That includes, for example, a child who reaches the cutoff age for coverage or a former spouse who gets a divorce from the employee. HOW MUCH DOES IT COST? Probably more than you expect. You have to pay the employee's and the employer's share of the premium -- or an average of $12,680 for families this year -- plus up to 2% in administrative costs. But legislation Congress passed earlier this year provides a 65% COBRA subsidy for up to nine months for people who lose their job between September 1, 2008, and December 31, 2009. WHO SHOULD TAKE IT? You can't be rejected or charged more under COBRA because of your health, so it's a good deal for people with medical conditions who might otherwise have a tough time finding affordable insurance. But if you're healthy and live in a state with a competitive health-insurance market (which includes most states other than New York and New Jersey), you may find a better deal on your own. http://blog.hr360.com/hr-blog/cobra-mistakes-dos-and-donts-video-blog Video Highlights: 0:02 COBRA violations can cost your company big. 0:38 COBRA is an acronym for the federal Consolidated Omnibus Budget Reconciliation Act of 1985. 0:46 This law gives certain employees and their family members the right to continue group health benefits provided by an employer when the employee’s job loss, death, or other specified events would cause coverage to end. 0:58 COBRA sets rules for how and when continuation coverage must be offered, how employees and their families may elect COBRA, and what circumstances justify terminating coverage. 1:24 It’s important to understand your COBRA compliance responsibilities. 1:35 Do count part-time employees to figure out whether your company’s plan is subject to COBRA. 1:43 COBRA typically applies to employer maintained group health plans with at least 20 employees on more than 50 percent of typical business days in the prior year. 1:54 Each part-time employee counts as a fraction of a full-time employee, equal to the number of hours the part-time employee worked divided by the hours an employee must work to be considered full-time. 2:04 Do stay on top of required notices. 2:15 Keep track of when and to whom notices are sent and provide a separate notice to the spouse or dependent child, if necessary. 2:25 Don’t overlook qualifying events. 2:29 The type of qualifying event determines who the qualified beneficiaries are and the amount of time the plan must offer health coverage to them under COBRA. 2:53 Don’t end COBRA coverage too early. 3:05 Qualified beneficiaries must be provided an early termination notice if coverage is terminated early. 3:18 Don’t forget about state laws. 3:20 Many states have enacted what are commonly known as 'mini-COBRA' laws, which may require continuation of group health plan coverage provided by employers with fewer than 20 employees. 3:41 Make sure that you do consult with a trusted employment law attorney or benefits advisor if you have any questions as to how COBRA applies or your obligations under the law. 3:51 You can also get more information at HR360.com, where we review COBRA in detail and offer more hints and strategies for avoiding COBRA mistakes.

Elite Home Healthcare Services - http://www.elitehhcs.com COBRA (Consolidated Omnibus Budget Reconciliation Act) is a federal law that may let you keep your employer group health plan coverage for a limited time after your employment ends or after you would otherwise lose coverage. This is called "continuation coverage." In general, COBRA only applies to employers with 20 or more employees. However, some state laws require insurers covering employers with fewer than 20 employees to let you keep your coverage for a period of time. In most situations that give you COBRA rights (other than a divorce), you should get a notice from your employer's benefits administrator or the group health plan telling you your coverage is ending and offering you the right to elect COBRA continuation coverage. COBRA coverage generally is offered for 18 months, and 36 months in some cases. If you don't get a notice, but you find out your coverage has ended, or if you get divorced, call the employer's benefits administrator or the group health plan as soon as possible and ask about your COBRA rights. If you qualify for COBRA because the covered employee either 1) died, 2) lost his/her job, or 3) became entitled to Medicare, the employer must tell the plan administrator. Once the plan administer is notified, the plan must let you know you have the right to choose COBRA coverage. If you qualify for COBRA because you've become divorced or legally separated (court issued separation decree) from the covered employee, or if you were a dependent child or dependent adult child who is no longer a dependent, then you or the covered employee needs to let the plan administrator know about your change in situation within 60 days of the change. Before you elect COBRA coverage, it's a good idea to talk with your State Health Insurance Assistance Program (SHIP) about Part B and Medigap.

The importance of health care benefits to employers and employees has led to the creation of a variety of federal and state laws. Several laws have been enacted to provide protection for employees who leave their employers, either voluntarily or involuntarily. The Consolidated Omnibus Budget Reconciliation Act (COBRA) requires that most employers with 20 or more full-time and/or part-time employees offer extended health care coverage to certain groups of plan participants. A qualifying event is an event that causes a plan participant to lose group health benefits. Typically, reduction in work hours or loss of employment constitutes a qualifying event for employees. Divorce or death of an employee constitutes a qualifying event for covered family members. When a qualifying event occurs, a complex notification process begins. There are a number of deadlines that the company and the employee must meet to comply with COBRA requirements. The individual no longer employed by the organization must pay the premiums, but the employer may charge the individual up to 102% of the premium costs. The extra 2% generally falls short of the true cost of providing this coverage. Compliance with COBRA regulations can be very complicated, and noncompliance with the law can lead to lawsuits and substantial penalties. Consequently, COBRA requirements often mean additional paperwork and related costs for many employers. COBRA administration is frequently outsourced to a third-party administrator that has expertise and data processing capabilities.

transcript While consumers search for affordable health insurance, they have price in their mind as the top priority. A general conception among the consumers is that cheap health plans should not be costly-the cheapest health plan available in the market is their target. However, this approach is not good. Sometimes, paying for a cheap health insurance plan but still not getting the required level of coverage results only in wastage of money. With the implementation of the affordable care act, the reach of affordable health plans is set to increase. Or at least, this is what is believed to be the objective of healthcare reforms. However, lots of consumers are still in confusion about how things would work. In this article, we will discuss some detailed options that consumers can try while looking to buy affordable health plans. To get a hand on affordable health insurance plans, consumers need to take of certain things. First among them is about knowing the options in the particular state of the residence. There are lots of state and federal government-run programs that could be suitable for consumers. Knowing the options is pretty important. Next would be to understand the terms and conditions of all the programs and check the eligibility criteria for each one of them. Further, consumers should know their rights after the implementation of healthcare reforms, and something within a few days, they may qualify for a particular program or could be allowed to avail a particular health insurance plan. If consumers take care of these steps, there is no reason why consumers can't land on an affordable health plan that could cater to the medical care needs. Let's discuss some options related to affordable health insurance plans state-wise: State-run affordable health insurance programs in California While considering California, there are three affordable health insurance plans that are run by the state government. Consumers can surely get benefitted by these if they are eligible for the benefits. • Major Risk Medical Insurance Program (MRMIP) This program is a very handy one offering limited health benefits to California residents. If consumers are unable to purchase health plans due to a preexisting medical condition, they can see if they qualify for this program and get benefits. • Healthy Families Program Healthy Families Program offers Californians with low cost health, dental, and vision coverage. This is mainly geared to children whose parents earn too much to qualify for public assistance. This program is administered by MRMIP. • Access for Infants and Mothers Program (AIM) Access for Infants and Mothers Program provides prenatal and preventive care for pregnant women having low income in California. It is administered by a five-person board that has established a comprehensive benefits package that includes both inpatient and outpatient care for program enrollees. Some facts about affordable health insurance in Florida While talking about affordable health insurance options in Florida, consumers can think about below mentioned options: • Floridians who lost employer's group health insurance may qualify for COBRA continuation coverage in Florida. At the same time, Floridians, who lost group health insurance due to involuntary termination of employment occurring between September 1, 2008 and December 31, 2009 may qualify for a federal tax credit. This credit helps in paying COBRA or state continuation coverage premiums for up to nine months. • Floridians who had been uninsured for 6 months may be eligible to buy a limited health benefit plan through Cover Florida. • Florida Medicaid program can be tried by Floridians having low or modest household income. Through this program, pregnant women, families with children, medically needy, elderly, and disabled individuals may get help. • Florida KidCare program can help the Floridian children under the age of 19 years and not eligible for Medicaid and currently uninsured or underinsured. • A federal tax credit to help pay for new health coverage to Floridians who lost their health coverage but are receiving benefits from the Trade Adjustment Assistance (TAA) Program. This credit is called the Health Coverage Tax Credit (HCTC). At the same time, Floridians who are retirees and are aged 55-65 and are receiving pension benefits from Pension Benefit Guarantee Corporation (PBGC), may qualify for the HCTC. Some facts about affordable health insurance in Virginia While talking about affordable health insurance options in Virginia, consumers need to consider their rights: • Virginians who lost their employer's group health insurance may apply for COBRA or state continuation coverage in Virginia. • Virginians must note that they have the right to buy individual health plans from either Anthem Blue Cross Blue Shield or CareFirst Blue Cross Blue Shield. • Virginia Medicaid program helps Virginians having low or modes

Consolidated Omnibus Budget Reconciliation Act (COBRA) of 1985 employee & family health insurance for disemployed The Consolidated Omnibus Budget Reconciliation Act (COBRA) of 1985 allows employees to continue health insurance into unemployment. The basic problem is that employees and their families covered by health insurance while employed, still need health insurance when unemployed, COBRA works to address this issue. “Qualifying events” for “qualified employees” allow the continuation of health insurance at the employee’s expense. Dental care, vision care, prescription drugs are included, life insurance is excluded. 20 or more employees qualifies the employer. Qualifying events include: death of employee (continuing health insurance for their family), termination or reduction in hours (because of resignation, layoff, discharge (gross misconduct is excluded), strike, lockout, medical leave or business slowdown), divorce or legal separation (affecting spouse’s health insurance), or dependent child outgrowing age of coverage.
